ILR Queries - help please

Hi,

My wife (main applicant), my son and I (both dependants of my wife) are applying for ILR from T2G in start of July 2021.

We have following questions:

1. The application flow asked for me (adult dependant) about UK absences (dates, countries etc) for travels during the leave post 11 Jan 2018. Our T2G current leave is Jul 2019-Aug 2022 (previous one was Aug 2016-Jul 2019). Based on this, I am providing info about travels done during and post Jul 2019. Is that ok?
BTW, it does ask for full duration for my wife.
2. Does anyone know why data for leave post 11 Jan 2018 is asked and not for whole 5 years? I travel quite extensively for work. Could it be because there are too many travels?
3. In the list of documents that the application workflow asks, it asks for my wife’s employer letter with details of absences, SOC code, still required etc. It doesn’t ask for such letter for me. Do I still need to provide such employer letter?
BTW, it does ask for employer letter for my wife.
4. My wife is on maternity leave receiving statutory maternity pay. I understand this will not effect her ILR application adversely? Am I correct?
5. We aim to apply using Super Priority. What’s the gap between application submission and appointments - how’s the availability of super priority?

From immigration rule 319E which relates to Partners of Relevant Points Based System Migrants:

any absence from the UK during periods of leave granted under the Rules in place before 11 January 2018 shall not count towards the 180 days;

No, because you are a dependant

1. Can the employer letter be a single document confirming “still required for foreseeable future” and absences in one letter? My company has created a single document as draft which is in signature process. I’d like to use it as is if that works.

2. On document upload, do we upload all pages of passport or just first and last page? I have the all pages scan but wanted to check.

3. Is it mandatory for employer to state annual leave allowance? The checklist from UKVI doesn’t ask for it. But I see few folks on the forum adding this to the letter. As I stated, I’d like to not cause a change to my employer’s draft letter that’s in signature process if this info is not needed.

It’s not required and as you correctly state the UKVI requirement doesn’t include this.

Also, I have a question on biometric appointment. We are total 3 applicants (main, spouse and child). Does this mean that we are restricted to using Core centres only? I have read somewhere that premium lounges and ESP don’t take party of 3. Is that so?

I entered UK on Tier 2 General on 3 Aug 2016. That’s also the date when my BRP/Visa for T2G started.

What’s the first day I can apply for ILR - is it 5th or 6th or 7th Jul 2021?

Multi country travel

Hi

Applying for ILR from Tier 2 G. Wife is main applicant and I am partner.

How do I enter absences from UK where my travel included more than 1 country - such as - London to Brussels (1 night in Brussels) - Brussels to Amsterdam (3 night in Amsterdam) and Amsterdam to London.

There is no way for me to enter 2 counties together since it is a single select field.

Do I report 2 entries -

#1 1st entry of 1 day in Belgium and
#2 2nd entry of 3 days in Netherlands?

If yes, am I not putting wrong info because for each entry I need to put date of return to UK (but actually I never came back from Belgium to UK. I went from Belgium to Netherlands.

Plz help. I have a couple of such multi country travels.

UKVI does not care about the specifics and the travel details. Only exit and entry from and to the UK matters. Simply say holiday to Holand and Belgium. What you did and how many countries you travelled to is not relevant

One more question: In the start of application, it asks for “In which Tier 2 Migrant category are you applying for ILR” -

1. In first selection, I selected “Skilled Worker or Tier 2”
2. Then a further subselection appears, where options are Skilled Worker; Tier 2 Minister of Religion; Tier 2 Sportsperson. There is NO Tier 2 General. My route is Tier 2 General to ILR. What should I do?

It appears the T2 General is now Skilled Worker.

We are a family of 3 applying Tier 2 General to ILR (my wife as main applicant, myself as partner and my son as dependent son). We are submitting bank statements and other proofs in joint names.

Which of the consents part apply for us?

Here is my understanding and doubts:

1. Part 1 - main applicant signs. Do I also sign for since my info will also be verified by Home office; do I print another copy and sign that for myself? Does my son also sign (he is 8 years old)
2. Part 2 - Do I sign as party in joint names? But I am not a third party since I am part of this application?
3. Part 3 - I don’t think this applies to us. We are putting no bank statements that’s in name of a person not on the application. Correct?

Documents for Tier 2 G to ILR

Hi board members

We are 3 applicants (main applicant + spouse + child) applying Tier 2 G to ILR. We had one leave Aug 2016 to Jul 2019 and second leave (on same T2G) is Jul 2019 to Aug 2022.

The document checklist asks “ f you have added a spouse or civil partner to
this application form who is applying at the
same time as you, please provide documentary
evidence of cohabitation since you were last
granted leave (up to a maximum of two years).
Evidence provided should cover the whole
period and be in the form of official letters or
documents, addressed to yourself and your
spouse.”

Am I right in only submitting cohabitation proofs (council tax, utility bills etc) for Jul 2019 to now? I believe these should be sufficient.

Or I need to submit for all 5 years 2016 to 2021?

Received Additional Home Office query

Hi Board Members,

We applied for Super Priority ILR for main applicant + spouse + child 1 at 1000 hrs yesterday 13th July. The main applicant is on Maternity Leave. All maternity proofs were provided.

On the next weekday 14th July (we applied on weekday) around 1700 hrs, we got an email asking why 2nd child who is 4 months old is not included on the application.

We replied that we will apply his ILR or MN1 once we have our ILR and that we are process of applying his Indian Passport.

3 questions:

1. Is the answer above we provided ok from Home Office standpoint? Or is it likely to attract another query?
2. Assuming all other aspects of applications are fine, when should we expect to get our decision?
3. Are we eligible for full or part refund of super priority £800 x 3 fee? I understand they did reply with query by end of next working day but it was not within 24 hours.

There is no claim to a 24 hour service.

The Gov.UK website does state that "A decision will be made: by the end of the next working day after your appointment, if your appointment is on a weekday", except that "You might wait longer for a decision if you need to provide more information. You’ll be told how and when to provide it."

Also see the Refunds policy caseworker guidance. I suspect that your case will likely fall into the two exceptions on Page 13.

Thanks secret.simon. 2nd child was born in the UK and is now 4 months old. Hence our view that he will be eligible for ILR or MN1 registration. Are we correct in thinking this?
