FLR (M) low income and benefits

Post by Miansh1 » Mon Jul 26, 2021 12:14 am

Hi,

I am a British passport holder and extending my wife and two kids visas under FLR (M). My total annual income requirement is £24,800. My wife and I both work. I earn around 1,158 per month salary which annual is £ 13,702; while my wife started the job in December 2020 and earning £970 per month salary before tax.
My questions are:
(1) Would Home Office consider the last 12-month income as a basis of application, as our salary over the last 12 months is 21,466 as my wife started her job around six months ago?
(2) Can Home Office approve our applications as together our salary are 25,500 and she has a permanent job as well? The problem we cannot prove is that we earned 24,800 over the last 12 months as the year to date our combined total employment income is £ 21,466
(3) I am also taking Universal Credit. So can I show it as an income?
A quick response would be really appreciated.

You cannot use benefits such as universal credit as income to make up the financial requirement. It is not your earned money.

Ok thanks. But should I have to prove that the required amount (£24,800) has already been earned in the last 12 months? Given that my wife has started the job six months ago so our total income has not crossed the required income threshold yet.

When an employee, one parent is required to earn at least £16,216.20 a year, £1351.35 per month for Universal Credit. Which is 35 hours a week at the hourly national minimum wage of £8.91. As you only earn £13,702, are you still self employed? Self employed have different rules to be able to sponsor.

Although you say in that thread that you are all British citizens.

Our visa is expiring in mid-August. So far, my wife and I have earned through employment £21,466 over the past 12 months. My wife started work in December last year, so she has not completed the full year in employment yet. Our total requirement for a visa with two kids is £24,800.

Were the kids not born in the UK? so that you can just register them as British and that will reduce your both employment household income to £18600 for your wife application alone.
