Query on ILR

I know it is too early to worry on this at the moment, but I would like clarify this. I am Tier 1 (General) visa holder, currently in U.K. My visa details are
Visa valid from: 02/08/2008
Date of entry in U.K: 28/08/2008

I will be completing the 5-year residence requirement on 28/08/2013 (assume I successfuly get Tier 1 extn for another 2 years), after which I can apply for ILR. But my visa gets expired just 26 days before the completion of 5-year period. In that case, can I apply for ILR or should it be FLR..?

Provided the rules for ILR still remain the same when you come around to apply, you can apply 28 days prior to completion of 5 years of your continuous stay in the UK.

I thought, you could apply when you reach 4 years + 10 months.
I have seen in the past few years ago,when it was 4 yr period for ILR, that people had applied 3yr + 10 months.

Correct me if i am wrong here.

you will be fine. just apply for ILR 28days before ur extension finish provided u get 1.

From your reply, is it 28 days before my extension finish or 28 days before my 5-year resident requirment finish? Please clarify.

As stated earlier, it is 28 days prior to completion of your 5 years continuous and legal stay in the UK.
