Working more than 20 hours

Post by midhun3197 » Thu Sep 30, 2021 7:14 am

*asking for a friend

She is on a Tier 4 visa, and a year ago her employer recorded wrong hours on their clocking system which for 3 weeks, wherein even though she did not work more than 20 hours the log shows 3-4 hours of extra work for about 3 alternative weeks. Since the employer paid her fortnightly, they balanced the hours the week after and hence the payslip shows 40 hours only. Her manager informed that he is willing to admit that he had made a mistake if in case there is any trouble. Given that a year has passed and that the employer is willing to admit what they did, will she face any issue in the future? Thanks.

she did not work more than 20 hours
This is the crux of the matter. There is nothing to see here.

Thanks ektan and sah10406.

The only worry is will the Home Office conclude anything from the hours recorded on the system if it all they check the system (don’t know when they’d decide to do so) - will they listen to the explanation why the hours shown on the system is nothing to do with her but her manager clocking the employees out whenever he/she decides to do so?

No. See my previous answer.

No. See my previous answer.
Apologies for the late reply.

I did. I understand what matters is that she didn't work more than what's allowed, but the record says otherwise, and only her manager at the time knows what happened. What if the manager is currently not working for the company - will his words be taken into account if at all Home Office raises a question, as the current person in charge definitely wouldn't know what happened 2 years back? Will the Home Office give an opportunity to the person in question to explain what happened? Pardon me as all these might seem to be extreme scenarios with slim probabilities of happening, but not null.

If she is concerned, she can speak to the international student adviser at her university, who will reassure her. As her friend, this is best way to help her.

Meanwhile I fear your own misplaced anxiety about this may be panicking your friend, when as someone else has already said, "She won't have any issues. Relax".

Thanks for that sah10406.

You’re right in saying that it’s my displaced anxiety. I will make sure that it is not conveyed to her with your responses. Cheers!
