The Government intends to put this before Parliament this year, for
introduction if passed, at the end of 2009. Assuming that this goes ahead, if you apply for a Spouse visa now, ILR will no longer exist as such in 2 years time, as it will be replaced with Probationary Citizenship. It will also take 4 years, instead of the 3 at present, to be entitled to apply for
British Citizenship. That is unless you have worked voluntarily for a charity, or a community project. This would reduce the qualifying period
by 1 year back to 3.

Hi , i am wondering if new rules going to effect those people who currently Hold ILR? Like i got my ILR-SET(M) in Oct 2008 and will apply for BC next yr in Oct 2009 if rules not gon effect me.

You might just be able to get your BC application submitted in time. No exact date has been posted yet. Otherwise it will be a wait of one more year.

I read the HO's proposal on the 'New path to BC' and it mentioned that the proposed changes will NOT affect EU citizens. Does this then mean that their non-EEA family members will not be affected as well and can therefore still qualify for PR after 5 years of continuos residence in the UK and BC after 6 years?

Mu understanding is that Probationary Citizenship will be basically be a direct replacement for ILR, but unlike ILR it will not be indefinite. You will have to within a certain time period obtain full British Citizenship or Permanent Residency. If you don't obtain eitther of these and your Probationary Citizenship expires you will have to leave the UK.

PR is according to EU legislation an cannot simply be changed unilaterally by the UK. BC is another story of course.

I agree with Djb's understanding of the regulation, according to information posted so far. Those here under EU law will be unaffected by the changes. Have a look at the Border and Immigration website,
www.bia.homeoffice.gov.uk and search for Path to Citizenship
