Student visa with Dependent children

Hi All,

Would appreciate some help on this.

A family member in Pakistan is applying for a student visa and has two kids. (Aged 4 and 1).

The applicant satisfies all student application requirements i.e. CAS, english and finances.

She also has enough finances to cover both her children.

My question is around sole responsibility.
The father will not be joining in UK and will not be part of the application.

So in this case, how can she prove that she has sole responsibility?

Considering the children are only 4 and 1 years old, will the compelling reason apply and award the visa with their mother?

If not, what documents do you suggest to prove the sole responsibility criteria?

Also - in terms of Care responsibility- is it enough to say that she has enough finances to send children to nursery while she is in University and also has family in the same city which can help take care of their children when she is attending classes at Uni?

You are mixing up two separate things: sole responsibility is one thing, and it is a matter of fact whether she has sole responsibility. If someone does not have sole responsibility, and the other parent is still living, then the application could only succeed with evidence of a compelling reason why the application should be granted.

Your family member needs to discuss her potential compelling reason with the international student adviser at her university.

Probably, but again the international student adviser can help her with this.

We have got in touch with the University and will hopefully get a response soon.

If you are saying that sole responsibility is a matter of fact, what documents will prove this? Any suggestions?

Presumably a court order ideally, but it depends on the country where they live. Entry clearance officers in that country will surely be used to seeing whatever evidence is used locally to demonstrate sole responsibility.
