Changing visas.

Hello All.
I found this site today and it was very informative. My question is slightly different and need to ask ..
Background: I am from the UK and my husband is Egyptian. We have been married for over 3 years. We have a child who was born in Egypt and has a British passport. I was living in Egypt with him then I went back to stay in the UK as my elderly father had health problems. My husband has been once before on a visitors visa and I go to Egypt when I can.
If my husband comes to the UK on a visitors visa can he then reapply whilst here for ILR? How much does this cost?

No.

He must return to his home country and apply for spouse visa then after two year ILR, then after another year Citizenship if he wants it.

You can't switch in-country from a Visit visa.

Costs are;

Spouse Visa - £385
ILR - £750
BC - £680

U can pay £200 more for same day service if u want.

Checked - £655, presumably the £680 includes £25 for summert - KOL test?

He does not qualify yet for ILR. As Wanderer wrote, he would apply for a spouse visa, from Egypt (definately not from the UK if on a visit visa). Exactly how long have you been married? Have you spent all your married life outside the UK?

In September 09 we have been married for four years. Can we get ILR straight away?

How long does it usually take for the spouse visa to be processed (all being well)?

oh and to really mess with your heads - -
Can he apply for the visitors visa ((he has had this before) then when that is granted (before leaving) also apply for the spouse visa???
Reason being is that he is afraid of being rejected for the spouse visa (housing and finances) but he wants to make sure that he can come to be with us (me and baby miss him too)!!

Moonlightsunshine, please see the requirements for 4-year ILE at
http://www.ukvisas.gov.uk/en/ecg/chapte ... %20sixteen.

In particular, there is a requirement to have lived together abroad for 4 years, which may become tricky since you moved back to the UK. There is also a requirement to pass the Life in the UK test.
