Do u think that the decision of 06 April 2009 can have any positive impact on the people switch over from WP to Tier 1 (G)

I was on WP and then switch over to HSMP Tier1 (G) in May 2008.

Can WP holder expect any benefit from decision in there ILR.

Sorry, but this judgment has nothing to do with Tier 1 applicants.

blue.olive, i am in the same situation WP-HSMP(Aug06)-T1(Jan09) but looking at the judgement i dont see myself eligible for ILR... after 4 years... so will have to wait for one more year...

I am sure there are many more like three of us who were initially on WP & are now in Tier 1 ... can we do something like our WP friends ???

Yes I am in for it. First of all congratulations to all HSMP holders benefiting from the latest case win :-)

I am in similar situation as many in this post-

1) Jan-2006 till June-2007 : WP
2) July-2007 till date: HSMP

3) Next: Tier-1 ...

The rules for WP holders was 4-years, same as HSMP. So I guess if we have paid the same level of NI and Taxes and no recourse to public funds, then we should be eligible for same rules isn't it...

WP holders will not benefit from this but I surely can say HO perhaps may not put retrospective changes in future after learning postive from this JR.

I had WP before new 5 year to ILR rule was implemented. I also qualified for HSMP. However, home office told me that WP and HSMP are treated identically for the ILR purpose and there is no need and benefit of switching.

Its correct there is not difference in treatment for ILR for WP and HSMP

but with HSMP you can work for yourself establish your own busienss with WP you have some restriction

But if you are only looking from ILR prespective, There is not difference in treatment
