Applying for Tier 1 and claiming benefits in the past

Hello All,
We are planning to apply TIER 1 (G) in Oct 09. Right now we are in WP since Oct 06. During this period, due to some incorrect understanding, we got 10% reduction (2nd home reduction)in Council Tax by showing that we have a house in India. Also after the birth of our child we claimed Child tax benefit for 3 months. In both the cases, the moment we realised that we are not eligible, we voluntarily informed this and stopped the reduction/payment.
Now my question are:

a) While filling up the application form do we need to specify these two cases?
b) Will HO have knowledge of this?
c) Can they deny our application based on these incidents?

Need some expert guidance on the same.

Hi, I guess other question you need to answer as well is if you have paid back the money you claimed. If this has not been paid back, then it may have some impact on your application. I’m sure other people in this forum would be able to comment on that; most especially people hat has similar experiences.

The application form asks if you are currently in receipt of public funds which you are not so you can answer "No". But it is advisable to mention that you had received benefits in the past in the covering letter.

Yes it's very important that you pay back the amount. If you have already done so and received an acknowledgement, you can attach that as well with your application.

HO may not be directly aware of this but if they do make checks they would come to know.

At the end of the day, unknowingly may be, you broke your visa condtions. But atleast by admitting it and mentioning that this has been corrected you can avoid being slapped a rejection/ban.

I think geting Council tax rebate of 10% does not constitues public fund.

That's correct. This rebate or even the single occupier discount of 25% is not covered under the definition of Public Funds. You should be alright.

MPs have been claiming expenses for duck ponds and DVDs then why not. On a serious note: Might have been an oversight by the council.
