Advice needed!!!

Post by ashishashah » Mon Sep 07, 2009 1:00 pm

Hi ,

Here is my history:

HSMP Stamped :Nov 2006
Came to Uk:Jan 2007
1st Extenstion:Nov 2008 for 3 years..Valid till 2011 Nov

Now,i am planning to go back to my home country..Chances are that i will get a job in IT compnay which will send me to UK for 2-3 months every year or some thing like that..
So can i apply for extension in NOv 2009 (instead of Nov 2011 )?I know its very early, but i want to keep my HSMP .

IF i apply for extension in Nov 2009 what will happen
a) i get extension from Nov 2011 to Nov 2014
b)I get extension from Nov 2009 to Nov 2012
c)Home office says that my application is too early and reject my application and i lose 1000 odd GBP

Would appreciate any inputs/help

Ashish

Ah, I didn't realize it was a hypothetical option. I personally feel that either of (a) or (b) will occur and (c) is unlikely. It depends on the case worker if they give you an early extension 3 years from date of expiry of current visa or not. I think push_hsmp had a case and can testify to this.

IMHO it's very early. Unless you can back up your early extension with a very valid reason, you'll raise eyebrows and might end up facing the prospect of option C.

Option D could be: At the time of your current expiry date (i.e., NOV 2011) if you are in your home country, you could apply for an extension at the British High Commission through their standard protocol for highly skilled immigrant visa. I do not know if it is possible like this, but you may send an enquiry to the BHC in your home country to confirm this situation.
