When to apply ILR at PEO

Hi,

Entered UK 30 Jan 2005 on Work Permit.
Currently on Tier 1 and Current Residence Permit expires in May 2011.
I know earliest I can apply for ILR by post is 28 before I complete 5 years in UK so it would be 03 Jan 2010 in my case.

Does same rule apply for PEO (same day) appointments as well? Am I eligible for applying for ILR at PEO on 03 Jan 2010?
