Tier 1-Student Dependent

Post by delta2001 » Sun Jan 17, 2010 8:47 am

hi,

My husband is currently in India. He was refused visa under the charges of deception(Section 320 7a) stating , for producing fake documents with a ban of 1 year.He left the country voluntarily on his own expense in Dec, 08.

His ban got over in December 2009 , can he apply for student dependant visa as i am currently studying in Liverpool university , holding visa till April 2011. I was given visa under the old rules, before March 2009.

Please confirm if he can apply for Student dependent visa? If he can, what are the possible reasons of his rejection , if in case it gets rejected as i am completely unaware of the same?

Many thanks
Laila Hasan

It Tier 4 (Student) and not Tier 1!

Reasons for refusal will depend on the (de)merits of the application. Irrelevant to ask general public to wild guess on what reasons your application could be refused.

Read point-based system dependent policy guidance. If you provide all necessary (and genuine) documentary evidence as required, I don't see why the application would be refused.
Also read Immigration Directorate Instructions > Chapter 3 Section 4

And please post your queries in the appropriate forum (e.g. - for this one, Tier 4 forum).

thanks for the guidance sushdmehta

but can he be refused on general grounds as well??..this is the only concern n if he would , that shows the visa would be refused even if we make 100 such applications n make appeals against it

im sorry that im making this silly point but i just require clarity..

thanks

You can apply, but you should apply on strong grounds.
As he had history of deception, so more or less documents would be verified, unless all documentations are from UK (especially bank statement).
So responsibility is more on your shoulder, that you show enough funds.

And if there are rejections on any unreasonable basis, that you would have chance to apply for administrative review and if that is refused, you could apply for limited appeal.

But best way to deal is prepare your case strongly, with enough money in your account and other relevant documents.

Try to avoid any document (especially bank statements) from your husband banks.

I hope it relieves your worries.

Cheers.

Well if all amount is in your account, it will take less time.
But if the amount is more in his account, than it should not be a problem, but definitely more time required for such applicants.
They verify most of the evidence to make sure that application is based on genuine evidences.
Best of luck.

It depends where your university is?
9 months or your expenditure + his expenditure + verification from university that you paid fees will do for you.
best of luck.

If you have been studying in durham for more than 6 months than you qualify for reduction in money required (see paragraph 61 of PBD dependent guideline document).
Well max you need
600X9 = 5400 (for yourself)
400X9 = 3600 (for him)

90000 pounds.

To be on safe side, provide these funds, other than your tuition fees.

best of luck.

why so much? I don't understand what you're calculating here. Why is it X9?

It should be X2, if she student spent established status in UK.
But as I am not sure about the status of student, so that is why I said max,

Sorry for 90K.
Its 9K.
Cheers.
