I came into UK as a Student in April 2003(2yrs Visa).And was on student visa until 2006(with Masters).

I then got married in June 2008 to my British wife.And was issue Spouse visa for 2yrs.
Got my ILR in April 2010.....I'm quite confused from suggestions made by friends that i can apply for NATURALISATION now!

I just want to find out if it is possible to apply for AN now since i've bn in country legally more than 6 years....Thanks

Have you been in UK for continuous 6 years? What was your status from 2006 to 2008?

I have been resident in the UK since 2003 and never illegally!
Travelled in 2004 for 10 days and in 2007 for 15 days.Those are the only times i've bn out of the UK since 2003.

It's been STUDENT Visa to SPOUSE Visa...and no other type of visa in beetween the years. :o

Under current rules it is irrelevant on what visa you were, what matters is that you had legal stay.

As a spouse of British citizen you don't need to hold ILR for 12 Months. Additionally your residence qualifying period is only 3 years.

Make sure on the day UKBA receives your application you were in the UK exactly 3 years ago.

Guys ..this is really interesting ..

so let us say ...wife gets BC first after her 12 months ILR stay..and then husband gets his ILR(both entered on 2 different visas. No dependant visa) after 5 wp....
At this point , can the husband apply for BC just becuase his Wife is a BC and he had 5 yrs legal stay?

i guess, husband needs to finish 12 months ILR. Correct me please

The requirement is that inorder to naturalise as a spouse of British Citizen (BC), the applicant has to have been resident in the UK for at least 3 years, amongst other requirements.

it does not matter what the status of BC was before the marriage, or how many years they have been a BC. To qualify via that route one just has to be a BC on the date of applying. Infact if you browse this forum you will find a number of people who have applied the same that their spouse received their naturalisation certificate

you will also note that you only need to have ILR, not for 1 year but even for 1 day

Thanks f2k. I didnt know that at alll. hmmm...as per your point , it doesnt matter what was the husband status before .....as long as the wife has BC and the husband has been here for the past 3 years legally then he can apply as soon as he gets his ILR based on the fact that his wife is a BC....

what is the benefit really ? i mean , if the husbans waits for 12 months and applies for BC by his route ...it just saves the time ..isn't it ?
