BDHC Mumbai overturned settlement application

Hi Friends,

Today my wife received a letter in the post, after a ECM review she now qualifies for a visa. The first line is as follows:

'A Manager of the Visa Department has looked again at your application and has decided that you now qualify for a visa.'

She applied for a Visa on the first week of June and was refused 4 weeks later. Mid-July I had lodged an appeal with the AIT and received a notice first week of August.

When lodging an appeal I was hoping for a reconsideration as the ECO was lacking evidence, so I got together documents that they'd need to reconsider i.e. An Independent Accomodation Report (I knew they'd require this but how it slipped my mind I don't know lol). So I lodged the appeal in the UK and told my wife to relax. I deducted from various sources that a reconsideration usually takes 2 months from the time the BHC/BDHC receives the Notice of Appeal. The letter is dated around 1 month after they received the notice, that in my opinion is outstanding lol.

Along with this letter, they have told her to submit her Passport & APP9 form (Appeal Withdrawal) to the BDHC Mumbai Visa Services Office. We as you can imagine are over the moon, thank God it didn't go to a hearing.

I know of friends in Pakistan receiving this type of Good news but when they submit their passports at Gerry's it takes a really long time for the Visa to arrive. I was wondering, how long will it take at Mumbai? Will they issue the Visa on the same day or will it take weeks like at Gerry's? I assume BDHC Mumbai handle the applications in-house unlike Pakistan who send it to UKBA Hub (Croydon).

Can anyone shed some light on this matter? So that I can advise the Mrs of travel/accomodation arrangements that need to be made when going to Mumbai.

just curious how long did it take to get your passport back with the visa, since i might be going through the same thing soon, just received a refusal this wednesday and am planning to appeal soon

Hi,
My visa also got refused and I appealed on the 5th of July 2011. I also got a call from the appeal office on the 8th for additional details.

We assume they are looking at our application and would hear some reply soon. I have read that it takes 10 days to receive a reply if its going for an appeal or decision is being over turned.

Please let me know your status too.

Where did u apply sri? wat they asked? m going to appeal next week? have u got any deadline for ECO date?

They had sent an IAFT2 form for appeal. We filled that form along with anonymity form (downloaded from http://www.tribunals.gov.uk/)

I sent my appeal form along with documents (covering letter + supporting docs) and sent to the Mumbai address mentioned on the refusal letter.

You need to apply within 28 days of receiving the refusal letter.
I also read the earlier we appeal, the better; it makes processing faster (not sure though, read on some forum).

Thanks Sri... My solicitor too said we will send it directly to mumbai.. and they will review and give decision in a month and if refusal is upheld than it will directly go to appeal...

Hi..

Yes, I got a letter today, dated 4th Aug'11.
It says "A manager of the Visa Department has looked again at your application and has decided that you now qualify for a visa".

So, looks like the BHC has overturned the original decision based on evidence provided. I have been asked to submit my passport and the letter received at BHC, Mumbai.

Fingers cross.. hoping the hard part was over. Looking forward for the further process.

So, guys for those who have applied for appeal recently, my time lines were:

- Appealed on 5th July
- Reached BHC Mumbai on 6th July
- Received appeal ack on 13th July which was dated 8th July (Postal delay due to weather, I guess)
- Received overturn decision on 8th Aug (approx 23 working days)

I have got a call on 2nd July from them for some info like adress... etc. But didnt get any ack latter, so as my friend who lodged appeal on same day as mine.

I got acknowledgement latter today dated 2nd August.... now hopefully another latter come soon which will ask me to submit my passport.

i got a letter today from the tribunal saying that the ECM in mumbai will now review the appeal and if he overturns he will contact my wife otherwise they will send the bundle to the tribunal in UK.

They said they will now write to me after 5th September regarding how my appeal will proceed. so i assume ECM will review appeal by 5th september and will make a decision on whether to overturn or uphold the refusal. what do you think?

Any updates on your case??

My refusal was related to accommodation and payslips though i had submitted all, they claimed i never submitted so i submitted again with appeal form...
