Conviction (using hand held phone while driving)

Hi

I want to apply for skilled worker immigration, just want to know i received 3 points through court in December 2010.

I was checking time in my phone when the traffic light was red and police gave me 3 points, i appealed in court but i was convicted (using hand held phone while driving).

Can i apply for Canada immigration now or do i have to wait until my conviction is unspent.

Please advice me asap. Thanks

Since you need a criminal report to sumbit with your visa application, why don't you see first if you have a criminal record. I can't believe that a cell phone ticket is part of the criminal code. it is only a traffic violation.
