T1 Switching Application returned as invalid - URGENT

Guys,
Need ur help to understand what to do.
I got back my T1 G switching application from UKBA after a month stating that it is invalid due to non standard photo.
Now, I have 2 issues.
1. My current visa already expired (WP - ICT).
2. Will get 5 points less at age criteria if I apply now (had b'day in between).

Is it possible to reapply now?

Does the letter from UKBA state that you should submit a new application with "valid" photographs?

Have you been given the right to appeal?

Nothing specific to appeal or fresh application.
However, they mentioned 2 things.
1. Arrangements has been made to refund the fees (I paid through Postal order)
2. ''please be aware that your attempted application has been rejected as invalid under the immigration rules, if you choose to submit a fresh application, the date of your application will be the date that
this fresh application form is submitted; that is the date that it is posted, delivered by courier or accepted at a public enquiry office. Please also ensure when submitting a fresh application that any documents enclosed cover the dates relevant to the fresh application (the date of your
resubmission).''

I have seen a similar case on this board where the applicants visa ran out by the time he got back the application as invalid due to photo. If you make a new application and explain in your cover letter and visa application form the reason for overstay, you should be fine. Please wait for other senior members to confirm and/or consider seeking a lawers help.

I am more worried for the point reduction due to my age if I apply now.

Unfortunately, you cannot request discretion on basis of above because UKBA returned your application within a month (as you stated).

Considering an out-of-time application is at UKBA's discretion, but I agree with suggestion by hsmp_1476 as you've no other option but to either try making a new application or leave UK.

Please note that you are now an overstayer, and submitting an out-of-time application will not change that. You can only hope that UKBA takes into consideration the reason(s) for an out-of-time application and accepts the application for assessment. As suggested, a covering letter explaining the facts should help.

Unfortunately, you cannot do anything with regards to the age points. Submit the application again only if you qualify.

HOW MANY DAYS passed from expiry of yr visa
if within 28 days than u can reapply

Its 31 days now.
What will happen if I made an out of time application now and that gets accepted? Does this overstay will become legal?
and in case of refusal, will it be refusal + 1 yr ban?

even my application has been rejected, i want to know that did u get ur refund money back, i mean ur postal order, and if u got it how many days it took for them to send u,

UKBA paid back the fees through cheques after 2 weeks.

Did you received biometric enrollment letter/acknowledgement letter ? or they sent your application back as invalid right after sending your application?.

Did you enroll your biometric? I mean, Has Rejection happened before biometric enrollment or after?

UKBA did not sent the Biometric Enrollment letter.
