Hi Mods and Friends,

I was grated Tier 1 ( General ) on 16th Nov. 2009 upto 16th Nov 2012. My DOB is 7th Nov. 1980. I remember I sent the form on 7th Nov 2009 stating I am 30 yrs Old. and was granted 10 points for the same. Now, the new guidance say that while applying for the extension in if your age is 30 or 31 you will be given 5 points. If i apply say on 18th Oct 2012 my age will be still 31 yrs. So, will be be granted 5 points of age?

Hello ursamyn,
As to what I understand from the new rules from 6April2011, all the Tier1 general migrants who got thier first grant before 6 April 2010, can claim points for their age at the time of thier first grant.
So in that case, if you were born on 7Nov 1980, your age on 16 Nov 2009 would have been 29yrs ( not 30 yrs as you said). Hence in October 2012 though you would be 30 yrs before your birthday, based on current rules you need to claim points as per your age during your first grant ie. 16 Nov 2009 in your case. So you will be eligible for 10 points I assume.
Can some one in this forum please reconfirm this.

Thanks guys....I am really sorry I had mentioned that I was 29 on my application form.....Now...If you see the current policy guidance....it has three bands for ages....


i.e. on page no 10 of 33

Under the age of 28.....20 points
28 or 29 years of age....10 points
30 or 31 years of age.....5 points

This is for extension of the people who have been granted Tier 1 (G) before 6th Apr 2010.

Thats exactly what we are saying here ursamyn isnt it? If the rules remain same by 2012...you will ge able to claim for 10 points ( 28 or 29 yrs) referring to your first grant of Tier 1 in 2009.

No worries ursamyn, Iam actually going through the same doubts as my Tier1 extension is due this September ....so reading each and every forum, articles and updates trying to be 200% sure about this and hence encourage all other members to assure and reassure us about this..only if they are sure about it.

Now, I am not 100% sure for S_saini....

But yes, if we follow the guidance notes....it clearly says....the points granted for Age when we did our first application....so if we follow it you should get 20 points for your age....but i would ask seniors to reply on that....

and for pkumar....i think you will also get same points as you were granted in your initial application....link given by tsar above to follow other topic wud be helpful....

hi guys, I was stumped initially as well. But having read the fine print in the guidance and also seen on the weblink below -

it clearly says that points for age would be awarded according to -
"Age on your application date for your first permission to enter or stay"

You can also refer to Guidance note 53 on Page 12 which explains the age clause in detail.

I applied in 2008 and I was 27 that time. I would thereby get 20 points when i apply later this yr in Sept based upon the fact that I was 27 yrs old in 2008.

But in points based calculator, nothing is not changed, it is still give points based on old criteria. ON page where we need to enter Age it says.

Extension applications
If you are in the United Kingdom and are applying to extend your stay you can score up to 20 points for your age if you are under 35 years old on the date of your application. The points awarded are:
Your age Points awarded
30 years old or under
20
31 or 32 years old
10
33 or 34 years old
5
35 years old or above
0

Dont rely on points based calculator alone,as it is a generic one.Download the form and guidance and go through it.It clearly mentioned the age criteria which applies to you.

The email that I had sent to know the same to UK Border Agency and the reply:

email sent:
"If a person (initially with HSMP visa) wants to apply for Leave to Remain or ILR which date of application is applicable to him to award points for his age? - date of application for his HSMP Approval Letter OR date of application for his Entry Clearance after getting HSMP Approval Letter?"

reply that I got:
"It would be the date of application for the HSMP approval letter.
