Hi,

I am a little confused about my ILR Qualification criteria such as 4/5 years, JR or not, LUK Test or not?

I got my HSMP Letter in September 2007 since then I got my Tier 1 in June 2009.

The HSMP Letter says "...... Against the qualifcying criteria - From 5 December 2006."

Do I have to wait for 5 years for my ILR?
Do I have to give LUK test?

No,but you will need it for citizenship application

You're not included in the JR as the ruling covers until Nov2006 only. so the answers to your questions are all YES.
