Tier 1 Extension - Points for Age

Post by Jbeez9 » Wed Jul 20, 2011 3:30 pm

I am applying for my Tier 1 extension, my current visa expires 15/09/11.

At the time of my first application I was 29 yrs old which I submitted in August of 08 and it was subsequently stamped and approved 15/09/08.

My birthday happens to fall on 05/09.

On pg 30 of the application it reads..
Please tick the relevant box to confirm the points claimed by the applicant on the basis of his/her age at the date of application for the first grant of leave in the category. Applications for leave to remain where the applicant has, or has had, leave as a Highly Skilled Migrant, as a Writer, Composer or Artist, Self-employed Lawyer, or as a Tier 1 (General) Migrant under the Rules in place before 6 April 2010, and has not been granted leave in any categories other than these since 6 April 2010

Under 28 years of age 20 points
28 or 29 years of age 10 points
30 or 31 years of age 5 points

Although I was technically 29 when I applied, my visa was stamped when I had already turned 30. Do I claim points for the date I submitted my first application or the age I was when it was stamped?

If I claim points for the date I first applied, will I need to show evidence?

Any help on this would be great.

As per my understanding, it should be the age at the date of your application, i.e. 29. If you earned 10 points at first grant of leave, you should earn 10 points at extension too.

Is this really true? I was 32 years old when I first applied for tier1. Now I am 35. How many points, I can claim?

You will get same points for age as you got in your first application.

I dont think this area has any sort of complications around it.

You wouldn't need to present home office any sort of extra proof apart from your passport which they would eventually have anyway.

the issue is I dont see any date on my passport that says my age at the time of application. How will they verify. Do they have my previous application on file?

Atleast you might have your date of birth on your passport man.

Obviously any passport does not reflects someones exact age at the time of issue.

That's precisely the issue, by the time my visa was approved I was a different age.

You should be able to claim the same number of points that you claimed in your original application.
