Problem with Accountant's Letter for PR -Tier 1

Post by ilrtier1 » Sat Oct 29, 2011 3:22 pm

HI
I need to apply for ILR.

I need to prove my earnings through ltd co also.
I got a letter from my accountant saying that,

After referring the company records we confirm that Mr.xx was due the following income for the year ending 31st August 2011.

I am much doubtful about the wordings " was due "

Could anybody please suggest me if the wordings are OK.
Does it states that, I have got these much earnings or I am due to get these much earnings?

Would the caseworker feel any doubt about the wording?

Please say what you feel

Thanks

I was out of job in 2009-2010 for 8 months also. I was in the UK during that time.

I got a contract job after the 8 months and incorporated a ltd company to do the contract work. I haven't paid tax or NI in 2010-2011 year for the contract work. The reason was I took minimum amount as salary (less than Personal allowance) from my ltd co.

Please advice if anything of these above would cause rejection

Thanks in advance

If you were liable to pay any taxes / NIC etc., but did not do so (for whatever reason), then it will be in your best interest that you pay (all) the dues - that you are liable to pay prior to the date that you make an immigration application.

Your accountant should be able to easily calculate the amounts due, if any, and also advise you whether any must be submitted before you make an application (i.e. - before a scheduled deadline).

If it has been calculated that there is no tax due to HMRC by way of your given situation you won't have broken any rules.

You aren't evading tax if you take a very small salary and 'top it up' with dividends.

You're also far from unique in your situation.
