Dear ny81,

I am an American myself -naturalized of course- and I must say this: you are not the only one in that situation. In the last two weeks, I have met several Americans in even worst conditions!

With that being said, and with not intentions to kick ya while you are down, my suggestions are:

1) Call your University to find out where everything stands. You "MIGHT" be able to work something out
2) You might be better off getting married here in the UK, although I don't know what's involved (paperwork wise, red tape, etc)
3) I don't know difficult UKBA will treat ya, since they might look at your -hopefully- new marriage/relationship as one of convenience (AKA: sham marriage). I suspect, and expect, they will give you a hard time, and keep in mind that you shouldn't need to retain an Attorney here in the UK, as applying for your EEA2 is pretty much straight forward. However, UKBA on their EEA2 RC form states that for "unmarried partners to prove they have been in a subsisting partnership of two years or more". But if you are denied/rejected, you can always appeal and/or reapply DON'T GIVE UP!.
3) If your intentions are those of moving back to the US, make sure you retain an Immigration Attorney to somehow make the transition smooth, right and legal. Nowadays, sponsoring your spouse/worker/etc; to the US is a pain in the ... That's the post 9-11 America.

Thanks for the advice Jrge, boy, I dont know how I got myself into such a mess. I know that the UKBA will give me a hard time and think this is a sham marriage, but hopefully we will provide enough evidence and we won't give up! The marriage that I had left behing was physically abusive, and I'm just glad that I was lucky enough to meet my future partner, wherever we end up settling! :) :) :)
