Travelling to Germany to Stamp 4EUFAM

Travelling to Germany to Stamp 4EUFAM

Hello,


I am an EU national but my husband is Non-EU (Pakistani national). We are planning to settle in Germany. We recently traveled to the UK with his Stamp 4EUFAM without any problem, and I understand that my husband doesn't need a visa for Germany as well. My question is: will we face any problem in Germany (Dusseldorf Airport)? I hope they know and apply Directive 2004 38/EC. Normally, airport border officials ask about a return ticket, accommodation, and funds. If I tell them that we are planning to settle in Germany and I will exercise my rights within 30 days (I will not wait for 90 days) by becoming self employed or self sufficient, and we have enough funds to reside in Germany, will they allow us to enter Germany? According to my knowledge and extensive research, my husband needs to apply for a residence card in Germany, not in the German embassy- Dublin. The mentioned embassy is responsible to give only a short-term Schengen visa to enter Germany for 90 days, but my husband is in the visa exempt category due to the fact he has a Stamp 4EUFAM. Is that correct? I will appreciate it if someone can help me.

Thanks for the respond, but what about Germany border officials, will they ask us about rent ticket, accommodation (hotel reservation) & funds and even if they ask we can tell them about our intentions. We will definitely find a residence before travelling to Germany. I can show them some kind of rental agreement and funds. Will they allow us?

I don't know what any particular IO may ask.

If you read the first link it will explain the legal position & your rights.
Suggest relax, smile, show a printout of the Directive if you have to - & stick to the rights.

Hello,


I am a EU national and my husband is a non-EU national (Pakistani citizen). We have decided to settle in Germany, as I will exercise my rights by registering myself as self-employed. However, we have a problem. I will really appreciate it if someone can help us.


Problem 1: My husband's STAMP 4 EUFAM (Irish EU family member residence card) is expiring in late June 2016, as Immigration office (GNIB) provided a stamp for only 1 year and 2 months, according to his passport's expiration date. We have been residing in Bulgaria (my native country) for the past 6 months. We decided to travel back to Ireland and renew his STAMP 4EUFAM and then travel to Germany. However, we think it's a costly step because we need to book a flight and search for an apartment in Dublin, plus pay deposit and rent altogether. I will appreciate it if you can advise me what we can do.


Problem 2: If we can directly travel from Bulgaria to Germany before his GNIB card expires (we are planning to travel on 1st June and his EU residence permit is expiring in 29 days). Yet, his new passport is valid for 10 years. Do you think that immigration border control at a German airport will make an issue, as I read somewhere that he should have at least 3 months minimum visa and valid passport to apply for a visa. But he is travelling with me and he is visa exempt, hence this condition should not apply to him. Am I right?

I will appreciate it if someone can help us.

I am just concerned for his stamp 4eufam validity. If someone answer on these issues. Just let me know if he can travel with me by using stamp 4eufam (1 month validity)?
