Travelling to Germany

Post by dRavn » Fri Jul 11, 2008 9:22 am

Hi there,

I'm a South African married to a German citizen and currently residing in the UK. My wife is currently studying here in the UK and I'm working. I have applied for a Residency Permit/Card and I have received documentation stating that I'm allowed to work and live in the UK while they are busy with my application. We intended to travel to Germany quite soon and arranged everything ahead of time, however the German Embassy sent my Passport back stating that the Residence Permit for the UK is missing.

I have phoned with them and told them my situation and that I have documentation that I'm allowed to live and work here but they said that they only accept the stamp in my Passport. I then phoned the Home Office and they told me my application is still in process and that the Embassy should know the procedure for the Residency Permit and that the documentation Home Office sent me should suffice. I tried the German Embassy again, same anwser, no stamp, no entry.

Is there anyone that can tell me if they are allowed to do this? I would appreciated it if someone can shed some light for me on this topic.

Thank You

Deon

dRavn, I have only just come across this fabled document today:

I'm sure one of the more knowledgeable, regular posters on this board will correct me if I am wrong, but as I now understand it, as the spouse of an EU citizen, you should only be requried to present evidence of your connection to your spouse (i.e. your marriage certificate) in order to obtain a visa.

If I'm not mistaken, the only issue regarding the UK Residence Permit would be to entitle you to a visa WAIVER. I'm not sure why they would need to see evidence of your right to live in the UK?

Thank you stmellon, I think I'll give the Embassy a call and see what they say about that.
