I managed to collect evidence since 1997 and seems like since he was a minor with a working father who was also a UK citizen, he would have been a Permanent resident by 2005 at the latest. Which means under EU Treaty rights he would not need private medical insurance for undergrad in 2008.
I think I was crazy stressed coz out of the 3 immigration lawyers I spoke to, one of them really spooked me out by giving me absolutely wrong information even about the basic stuff and constantly telling me that I have been living here under the wrong permit so far. She kept coercing me to pay her thousands of Euros to 'fix' the matter by her writing to the DoJ that my residency so far doesnt count?? And that I would have to leave the country before my card expires.
But I think my head is clear now and I have enough evidence for my case.

Just updating my timeline :
05/07/2025 - EUTR1 form submitted.
08/07/2025 - Documents received by DoJ.
06/08/2025 - Letter from EU Treaty Rights telling me I would be processed under WA and requesting additional documents.
13/08/2025 - Additional documents sent.
22/08/2025 - EUTR1 approved and 5 year WA permit issued.
Just to be clear, mine was just a renewal of WA permit and we involved TDs coz the case was confusing and I am heavily pregnant. I am sure that the process was extremely quick only coz of TDs intervention.
