Hi, I am looking for advise and information about TUPE process for Skilled worker visa migrant its impact on travel outside of UK.
> Currently I am working as a skilled worker migrant employee with company A, its valid till Aug 2025.
> The work I do is now taken over by company B and both companies agreed to TUPE my employment.
> Company B also got sponsorship license recently. and they said no need to apply for new CoS as my current skilled worker visa is valid till Aug 2025, and said they will handle this under TUPE process and inform Home office about employment transfer vis SMS (Sponsorship Management System).
If TUPE process is in progress with Home office (after both companies initiated TUPE process their end)
my concerns :
1) How long TUPE process may take with Home office and UKVI so that my employment and sponsorship transferred to company B ?
2) Am I allowed to travel out side of UK while this TUPE is pending with Home office. I have travel plan to go home country and booked tickets as well. now bit worried will this TUPE effects my travel and makes any complications when I return back from home country? (I am aware for skilled worker visa sponsor change if application is pending with UKVI, employee is not allowed to travel outside of UK, other wise application get disqualified. but not sure is same rule apply for sponsorship employee under TUPE process)
quick advise really appreciate, as my company B going submit the TUPE in a week and I have plans to travel home country in mid of December.
