WP (TWES/Mult Entry) eligiblity for ILR

Post by ks22 » Fri Nov 26, 2010 10:15 pm

Dear Moderator and Members

I am due to apply for ILR as I am coming up to complete 5 years on 2 Feb 2011. However I have just noticed that my entry clearance (Visa in passport) states the category as work permit (TWES), however the work permit itself states Multiple entry. This has always been a source of confusion and I did manage to get a extension of leave to remain, based on IED, in country.

My immigration history is
WP (TWES or MULT ENTRY) Feb 2006 to Jul 2006
WP Jul 2006 to Jul 2007
WP Aug 2007 to Feb 2008
WP Feb 2008 to Aug 2008
WP Aug 2008 to Apl 2009
Tier 1 Apl 2009 till date
My first employment did not fit either the TWES or MULT entry criteria so I am not sure if the visa was given in error.

My question is, do I qualify for ILR in Feb 2011 as I assume I do or is the period I was on TWES/mult entry invalid?

Could anyone suggest good immigration lawyers for me to get professional advice?

Thanks.[/b]

Thanks for that Vinny. I had seen that paragraph earlier and according to that I would not qualify for ILR in Jan 2010.
My wife is eligible for ILR on 16th Jan 2010. Would it be possible for me to become a Tier 1 dependant and then apply for ILR together in Jan?

Also if I were to become a Tier 1 dependant is there a restriction( time frame) before which I can apply for ILR with her ?

Do I need to have a reason to switch to a Tier 1 dependant visa even though my existing LTR ( Tier 1) does not expire until 2012?
Thanks.

I didn't see that time spend under WP (TWES) was excluded.

To qualify with your wife, you would need to obtain entry clearance as her dependant and have lived with her in the UK for at least two years. See also Info Needed ILR Urgent.

Hello ks22,

Were you able to apply for ILR with this combination?
Please could you share your experiences.

I was issued Work Permit (Multiple Entry) for 2 years. Before the WP got over, while I was in UK, I applied for Tier1. I will be eligible in the very near future if this is acceptable. If not, I will have to go for a tier 1 extension. And, that would mean I will be eligible only after 2 more years (if rules dont change).

So, please can or someone share their thoughts / suggestions / experiences.

Thanks in advance.

Aam
