Additional work more than 20 hours per week / Locum work

Hi all,

I am on Skilled Worker/Health and Care Worker Visa and I'm considering decreasing my contracted hours so that it meets the threshold/minimal salary and do locum work in the rest of the week. The idea is to gain more flexibility and higher hourly pay.

I would like to ask you, how serious is exceeding those max 20 hours per week in case this ocassionally happens?

I read that 20 hours weekly are counted Monday - Sunday and it's no average over a couple of weeks, which would make things easier.

Anyone cancelled / deported after breaching this rule?

If you’ll be working more than 20 hours a week or in a different occupation code

You’ll need to apply to update your visa so that you’re being sponsored to do both jobs.

You’ll need to:

• get a new certificate of sponsorship from your second employer
• include a letter with your application explaining that you want to change your current permission to stay

If you exceed 20 hours just once in any one week then you have breached your visa conditions. That will leave you liable to your visa being curtailed.

There are also implications for your current sponsor and any employer that allows you to work more than 20 hours in any one week.

Please also remember that the Home Office have access to your HMRC records so it is not exactly difficult to see what you have earned and from whom.
