@astana: Hope you too are reading all the posts properly. The discussion on exceptional circumstances started as Am0na has been granted RCoS exceptionally outside monthly allocation and that too without any request!!

In order to be considered for exceptional allocation, the employer needs to write to HO detailing the situation and HO may or may not agree on that.

So, people will obviously discuss about this exceptional case of approval until it's not 100% clear how it happened ! Hope it's clear as we are still interested to know about this case. You can still believe in your lawyer. Not everyone has hired a lawyer and I assume the people stuck on this forum for past 5-6 months are more experienced than any lawyers!

I have been just approved with 50 points.my solicitor has just forwarded an email that home embassy sent and it says the same which amona has mentioned outside monthly allocation exceptionally granted.

I have 34 points and have been denied in the April round unfortunately. Immigration lawyer has advised that it's unlikely May will be any better for me. Fingers crossed for everyone still waiting to hear.

To accommodate 50 points band, 100 certificates have been borrowed from next month. But, there may be a few more applicants say 5-7 still left over, and it may be possible that HO would have granted CoS to such 5-7 applicants exceptionally to clear the 50 point band!

Here, 5-7 is just assumption which may be a little more.

Example:
Let's assume 300 certificates were still available after granting RCoS to all Shortage Occupation / PhD and anyone with 55 or more points.
Now, assume there are about 409 (+/-) applicants in the next band which is 50 points.
The remaining 300 certificates are not sufficient to accommodate all 409 applicants. So, 100 certificates have been borrowed from next month (as maximum 100 only can be borrowed). Still there are 9 (approx) applicants left over in 50 points band. If they don't consider these 9 applicants under exceptional case, then all the 409 applicants have to be refused.
Now, HO obviously can decide on their own terms to grant a few certificates exceptionally to clear the entire 50 points band, which makes sense.
I believe this is what has happened this month.

If so, we are expected to see the cut-off at 50 points with 100 certificates borrowed from next month.

Finally received the email from my employer.

Non shortage, 50 points (54k salary). Approved today under normal qouta (no exceptions or anything). First time applicant.

Best of luck to all 45 points and below.

50K Non-shortage RCOS approved today afternoon. I found this forum to be the only support during these two months. Thank you all for keeping up hope through messages and useful information. All the best to all who are below 50points.

I am still waiting at 40 points. No rejection yet but I did see that someone with a 43K and 40K with rejection so I am assuming I am receiving that email tomorrow... through a part of me still has hope.

Yeah, this in an interesting theory. I think they have done _something_ with the 50 points to bring it down to 46 - if only for optics.

I am feeling same, 45points. someone got refused. And HR didnt' receive any response yet. I guess I will get negative reply from them soon today or tomorrow. Do we get the RCOS in May ? if not then ... no way to get the RCOS someone who has below 50points. I believe both April and May is the best time to attempt but so far not good to me.. :0
