Children status after parent death

Children status after parent death

Hi guys,

Asking on behalf of a friend.

The father passed away on 4/1/2023 and he was on a skilled worker visa issued on 8/11/2022 expiring on 14/2/2023, which was an extension to a tier 2 visa.

His children, 13 and 18 years old, are on a dependents visa on him. The older is in university and the younger at school.

His wife is on a tier 2 visa expiring on 18/2/2023 and her work agreed to extend her visa for another year to a skilled worker visa, she’s still waiting for the CoS.

Both parents work for the NHS.

What would be the best option for the children to continue staying legally in the UK?

Is it correct to say the children have 60 days from when their father died to adjust their status?

Would the mother just apply for her visa extension and include the children as dependents?

Agree that the mother may include her children in her application before their leave expiries.

Would you know how long do the children have to adjust their status before being considered illegal residents? I’m assuming once the father (main applicant) dies then his visa expires and consequently any dependents.
