One of my friend's wife did not pass her course of study from International Business College Manchester at level 7. She did not pass the course. She has a sponsor who is willing to hire her. But she is not sure she can apply to skilled visa or not. As she failed the course.

Has she completed the course but has failed the exams? If that is the case she can move to skilled worker visa.

Yes, thats correct.

She has completed her course whose
start date 26/09/2022 and end date was: 22/09/2023.

But failed the exams.

She got an email on 19 Sep 2023 that she failed all 3 units toward level 7.

The student rule changes in July 2023 state that if the full course is completed, regardless of the outcome, this will allow the individual to apply through the skilled worker route.

As long as the above is fully met then she is able to apply for a skilled worker visa with the appropriate COS / Sponsor etc.

What the general guidance states

If you’re currently in the UK on a Student visa, you must also meet one of the following requirements:

you have completed the course you were sponsored to study
your job start date is after your course has finished
you have studied for a PhD for at least 24 months

Thanks for clearifing this.

In option B "your job start date is after your course has finished", Sponsor must be HEI - track record of compliance. So not appliable.


Her sponsor is not "HEI - track record of compliance". I hope that is not an issue if she apply according to option A.

The guidance does not mention anything about sponsor must be HEI. A sponsor can be any company or institution with a licence to sponsor foreign workers.
