Late In-country Skilled worker visa application

My sponsor misinformed of the status of visa application, stating that they made a visa application on my behalf and was advice to wait for HO notification, however, only sponsorship application was made. I submitted an actual visa application about 7 weeks later, what other information can I provide to ensure a favourable outcome.

What was the last visa you held and expiry date?

Does the employer have approval of their sponsor license nd CoS or is the application still pending with ukvi?

Late visa was a student visa. Both employer license and COS still active

19th of January, the visa application was submitted after 8 weeks of waiting, as misinformed by the HR

What date did you submit the skilled worker visa?

You are an overstayed now and are not permitted to work at all.

Why did you not apply for the graduate route visa before your student visa expires?

The organization has already commenced the sponsorship processing. I already have an application with HO.

Really unclear what the employer has applied for or are doing?? They either have a licence or they do not.

Did the company give you a CoS to apply for your visa?

If you submitted an application after your student visa expired, you are an overstayer.

How do you expect strangers on an Internet forum to help you when you don't provide precise information with all relevant dates etc.

Thanks for your response, much appreciated. All details your requested were already mentioned in previous posts. Visa expired in Jan, COS was provided and is still active and the visa application was submitted in March, upon realizing the employer did not do the visa application as initially stated. Just seeking for advice. Thanks

Your case is complex now as you are an overstayer. You cannot work at all. No guarantee you will get a visa either.

From what you describe this application will probably fall under general grounds for refusal as you are an overstayer.

Having a CoS does not trigger section 3C leave only active visa application does.
I think at this stage you should seek legal advice. If you leave now and withdraw your application you might be able to apply from overseas and get but even this might fall under general grounds for refusal as overstaying might trigger entry ban.

Out of curiosity, can you please state here when your visa expired when you applied for the new visa and what if any explanation/evidence was supplied to justify the late application?

It can be handy for people with similar issue in the future.
