My company faced the same thing. They hired a rather expensive immigration lawyer since they were doing this for the first time. The firm did not give my company a good picture of the whole situation which I am sure they must have been aware of seeing so many applications being refused, they just kept saying that they need to reapply the next month because of the backlog which will be cleared in the coming months. Same, completely clueless. They now want to try again in June at 45 again. Wondering if I should try or should I go ahead with another offer I have in another country.....the UK job is better which is the only reason I am struggling to decide. For 2136, it is only very specific jobs that fall under the SOL (not SOC). As you don't state what your job title and role is, hard for anyone to comment.

My Job Description is Senior Software Developer (7 years exp) and fits as :
Senior developer employed by a qualifying company, where the job requires a person with a minimum of five years’ relevant experience and demonstrable experience of having led a team.

RLMT would NOT be needed if the SOC was SOL.
I don't believe the NHS is a 'qualifying company'. Qualifying company does not mean an approved sponsor by the way so you are likely not on a shortage occupation SOC under 2136. Appendix K clearly states what a qualifying company is.Yojana wrote: ↑Wed May 23, 2018 11:34 amThanks for responding!

RLMT would NOT be needed if the SOC was SOL.-> This is confusing as my employer did RLMT to apply for RCos.
Could you please guide me to know the exact application way (SOC/non SOC) in my case?
As this is their first experience, I need to dig in to get more details around it.

4. In this Appendix “qualifying company” means a company which:
(a) has obtained permission from the Home Office to issue a Certificate of Sponsorship in respect of the relevant job on the basis that the job is included on the Shortage Occupation List and the company:
(i) is licensed as a sponsor for the purposes of Tier 2 of the Points Based System,
(ii) at the time of obtaining such permission, employs between 20 and 250 employees (inclusive), or employs fewer than 20 employees and has provided a letter from the Department for International Trade, confirming that the Department has been working with the company and supports the application in relation to its trade or investment activity,
(iii) is not more than 25% owned by a company which has one or more other establishments in the UK and one of those establishments employs more than 250 employees; and
(iv) has not been established in the UK for the purpose of supplying services exclusively to a single company or company group in the UK; and

I was told by my sponsor that application can be submitted around 1st to 5th of every month. As I see above was submitted on 23rd..would like to know from when (I mean the start date) can these actually be submitted.
