Skilled Worker - ILR for dependents

Post by Waseem432000 » Wed Dec 07, 2022 10:53 am

Hi everyone,

I will be completing my 5 years on Tier2/Skilled worker visa in July next year and reading all the previous topics, my spouse who joined me after 6 months in the UK, will need another three years' visa as my dependent but she will be able to apply for ILR after she completes her 5 years (Feb 2024). I have a question about our children.

I have two girls and both are born in the UK I remember reading in a few topics here that they won't need to apply for ILR and can apply for citizenship after I get my ILR but going through the following link, am I correct to assume that's not valid anymore and they will need to apply for ILR and spend 12 months on that before they can apply for citizenship. Looks like things have changed after 30th June 2021.

You're looking at the information about being British by birth. Your children aren't British by birth, you still have to register them, but you can do it via MN1 according to 1(3) - https://assets.publishing.service.gov.u ... -Sep22.pdf

For a UK born child, they can be registered as a British citizen when one of the parents has ILR.
Section 1(3) - A child born in the UK whose parents are not British citizens and were not settled in the UK will have an entitlement to register when one of their parents become settled in the UK or become British citizens.

Thanks for clarifying that.

I know my kids aren't British by birth and I will need to apply for them to be British but can I do that directly after I get my ILR and they won't need to apply for ILR themselves?
