SKILLER worker visa Separated spouse - CHILD Visa application

HI

One of my Colleague is on SKILLER worker visa with new company and their children are on OLD COMPANY DEPENDANT VISA. Unfortunately she got disputes with her husband during october 2022 and Council/ Social reformers got involved supporting the colleague and children. Child has complaint the school about the father 's behavior.
Council has ordered the husband to stay separately from children ( 1 girl baby and 1 boy) for some time and then disputes with in family increased. So he left to India in November 2022.

Now the children dependant visa is getting expired in march and she is in process of applying new visa. Can she apply visa for children with out her husband signature /consent ? He is very rude and not willing to sign/provide his consent to it though social reforms requested him to sign and go.

Please advise on the process as she need helping hand.

I would strongly suggest she gets professional legal advice as this is a very complex situation if social services is involved. Given that very small children are involved and social services are involved, it would be best not to post on a public Internet forum asking for advice, which is searchable for anyone, to protect the mother and children. Her employer should have a legal person or company that can help her.

Children of pbs migrants cannot usually extend their visa without their other parent extending their dependent visa at the same time, regardless of whether the parent gives consent or not. The immigration rules are very clear on this.

She is going to require substantial evidence, justification and legal help to get the children's applications done and hopefully with a successful outcome.

There have been successes, so please tell her not to be scared but to prepared everything carefully as to the situation and why the children should be granted a visa extension.

She could also ask the court for sole custody order etc and social services could help her.
