SW Dependant Visa Extension if lead applicant has settled under long residence route

Hello everyone. I got query in regards to applying for Skilled Worker Dependant Visa extension.

My spouse (being the lead applicant) has settled few days ago under long residence route (10 years) - she held Skilled Worker Visa before she settled. I'm currently in my 4th year of Skilled Worker Dependant Visa (thus both of us are short of 1 year to apply ILR under 5 year route).

However, my visa is due to expire in Dec-23. My question is, can I apply for an extension thus allowing to apply ILR under 5 year route next year?

Home Office PDF Guidance - “Dependent family members in work routes Version 12.0”, there’s this statement - “If the lead applicant has settlement on the basis of long residence (including where they have subsequently naturalised as British citizens) provided they held leave under the relevant PBS route at the time when they settled, their partner can extend their permission or gain settlement as a dependant under these routes.”

The above suggest that I can apply for extension?

From my research, it seems that the statement above was recently updated. This causes a bit of confusion as some lawyers that I consulted say that I can't extend and must switch to a spouse visa of a settled person.

Yes you can apply for extension.

The dependants may apply for ILR in that situation but an extension does NOT seem to be possible as per paragraph SW 36.1. of the rules.

UPDATE: Just wanted to share that my Skilled Worker Dependant visa extension has been successful. 3 years extension was granted. Also no IHS as visa is under shortage occupation. Thank you both.

Hello @ctcarda. Can you please advise what link you used to extend your visa? also Did you provide the UAN for your partners ILR application. And when they ask for Start and end date work dates what did you provide since your partner has no start and end dates anymore when he settled?

1) Just google skilled work extend visa
2) Yes
3) They didnt ask this. Only ask what time period does CoS cover to which I answered 3 years or less
