Tier 2 general - dependants extension - Main applicant switched to ILR

Post by venval » Thu Jul 07, 2022 9:51 am

Hello Team,

Thanks for looking into this post.

Context: By combining my Tier 1 Entrepreneur and Tier 2 General period I have received my ILR in May - 2022. My Wife and 2 kids have to apply for an extension before they eligible for an ILR.

My wife and kids arrived UK in Sep-2018 as Tier 1 Entrepreneur dependents

They switched to Tier 2 general dependent in July - 2019

My questions:

1) Their visa is about to expire this month on 22nd. What link I should follow to apply for their visa?

2) Can I ask for 2 years visa instead of 3 years?

3) Since I have no more on Tier 2 visa, Will I be able to apply under tier 2 route or I have to apply as ILR dependent?

4) Do I have work full time? I meant do I have to provide my current payslips?

5) Is there any maintenance funds I have to show?

Thanks for your valuable time

1) Their visa is about to expire this month on 22nd. What link I should follow to apply for their visa?
Skilled Worker/PBS Dependent.
2) Can I ask for 2 years visa instead of 3 years?
No. The immigration rules state it will be a 3 year extension if the main PBS migrant has ILR or is British. There is no discretion to grant a lesser time by a caseworker.
3) Since I have no more on Tier 2 visa, Will I be able to apply under tier 2 route or I have to apply as ILR dependent?
Skilled worker/PBS Dependent. Switching to ILR dependent will reset their ILR clock to zero.
4) Do I have work full time? I meant do I have to provide my current payslips?
No and No.
5) Is there any maintenance funds I have to show?
No.

Can someone share the exact link? I felt I have used the wrong one.

As part of this application HO application in iOS have taken my wife's BRP details as well as her face image.

In application, I have entered my OLD BRP details which has expiry data 22-07-2022

IHS fees is showing as £0, It should take approx £1800. I completely lost.

Can someone help me here?

Thank you

You're on the right form bro. Relax.

If you had selected yes in the field 'are you eligible for healthcare worker visa' question, you'll be exempted from paying the IHS.

Now you can re-use your Biometrics. But this is applicable for a selected few. You don't need to get a Biometric appointment if you're choosing to verify your identity using the UKVI app.

So, relax.. You'll be alright.

Hi

Thanks for your swift reply.

I just checked the application I filled in.

Has your partner been informed they are eligible for a Health and Care visa?

I selected NO

It might be the end date of my previous BRP i.e 22/07/2022.

I am unsure about this.

For the ihs fee, you must put a date 3 years in the future to get the correct fee

Thank you

I tried to do that but its kept on saying £0 as IHS fees. When I clicked on continue IHS reference number has been generated.

Do I have to delete the application and start again?

Hi
Could you please let me know if you got the extension after the above procedure.
1. I am on ILR converted from Tier 2 general visa in September 2021.
2.My partner and kid are on Tier 2 general dependent visa (PBS dependent visa) and they are not eligible for ILR as they are yet to complete 5 year on this visa. Prior to that my partner was in Tier 2 ICT visa and kid Tier 2 ICT dependent .
3.Now to apply for extension , which form we should use since I am in ILR ?
Should this be Family Visa or It should be again PBS dependent ?
4.Could you please share the application form .

Hi Sheeja,

I am still yet to figure it out the correct application form.

One thing for sure I have to apply PBS dependent as others suggested, however, On the page there are multiple links as shown below.

Can someone tell me which link I have to use?

If applying at the same time as you, then use link 1, else use link 2.

But if you are not applying, then use link 2?

Thanks for your response Vinny.

I have used link 2 for my partner and child as they shown in the website.

For the below question

How long have you lived in the UK?
I have included the time she spent in the UK on previous visas as well. for e.g. PSW dependent 11-2012 to 09-2013.

There is a gap between switching her visas and she was outside the UK during that time.

My question is as follows

Do I have to just mention the time since her last arrival to the UK? I meant since 09/2018 or what I did above is correct?

Regarding her bio-metric: I have used HO mobile app to prove her identity. I assume NO walk-in bio-metric appointment required.

They did request only one document to prove we both live in the same address.

I was under impression that I have to submit her passport, current BRP copy & marriage certificate.

Did I missing anything while filling her application? or was this expected I meant they will take those documents from her previous application?

One final question

I have downloaded her application, in that, I found as follows

TYPE OF VISA/APPLICATION: Dependant Partner

It should be showing as PBS Dependant Partner instead of Dependant Partner. isn't it?

I am also on the same page as you on below query.
How long have you lived in the UK?

what did you answer?

Do I need to include only time on Tier2? or on previous visas like Tier1 PSW, Visitor Visas?
