The hours on payslip is irrelevant since the job table has only one hourly pay.

However, even if 7.50 is used throughout, you will still be over 130 hrs/month combined.

Just do the calculations in your AR month by month

e.g.
Aug 2016 - Employee 2 (51.84 hrs) + Employee 3 (99.84 hrs) - Total 146.68 hrs, which is greater than 30 hrs/week.

Do that for all the 12 hours and make clear you are using 7.5 as that is what you entered wrongly in the job table, but the numbers would be higher if actual hours in payslip are followed.
Thanks Marcnath, i will do the same as you described above
i have gone through policy guide again again and cant see anything about jobe title .
and also on policy guide there are some examples for how to fill application form which have cleared the confusion of job title only thing is coming in to my mind is following i did not filled this section in my application.
start date with your business ( if this differs from satrt date in job)

The start date with business only needs to be filled in if it is different from start date in job (which I assume you filled) .

Since the refusal letter did say "title", you should also address that and state that the immigration rules has no requirement that the two jobs need to have the same Job Title. (I still think they meant total and made the typo, but you should address it anyway)

Hi Marcnath ,

As I'm doing my AR need your advice

As you know employee 2 started with the company
From 4-Jan-2016 and employee 3 from 11 April 2016

If we consider the start date with business is same so can I do the calculations like ? Please see following

Employee 2 Jan 16 (36 hours) + employee 3 April 16 ( 104 hrs ) total 140 hrs
And then carry on Feb , march ..... for 12 months.
OR
for 12 months before my application submitted
See following please

employee 2 Aug 16 (54 hrs) + employee 3 (104) total 158 hrs and then carry on Sep, October .....till July 17
As I sent my application in august 17 and sent my pay slips and RTIs till July 17.

I don't see a major issue with either, but given this is an AR, you should try to stick as close to the original application as possible.

So, just going for the second option starting from Apr 2016 makes sense to me.

What was the reason for refusal
Did they respond you when you emailed them or themselves sent it?

There was another recent refusal posted here where the HO specifically mentioned the reason was that both part-time jobs did not have the same title.

There may have been others, so HO has probably looking at all of those cases and reviewing the situation. That would be my guess.

I don't have the link to that post at hand.

But I think it was much more recent, so possibly still in AR

HO can definitely review the whole application again, ask for more documents, etc. If the decision only talked about the job points, it is possible the CW has not checked the other attributes still.

ADMIN REVIEW REPLY

Post by Leeee704 » Wed Jul 11, 2018 11:41 am

Deaar Gurus i am starting a new topic as old topic is been loacked by admin as they thout that is end of my case.
My Admin review for tier 1 Ent extension is been succeeded

my admin review says as follow,

you application for leave to remain has been returned to the original case working team for reconsideration.
a new decision will be made on your application and you will be informed of the outcome. if your application is refused you will be entitiled to apply for fressh admin review of the decision.
your existing leave and conditions of leave are extended under sec 3c of the 1971 immigration act while your application is under consideration.

ADMIN REVIEW : NOTIFICATION OF OUTCOME
we have carefully considered the points that you raised in your admin review. we have withdrrawn the orignal decision because we have found that the orignal decision maker made an error when considring your application.

we have returned your leave to remain application for reconsideration and a new decision will be made. we are unable to correct the error because reconsideration is outside of the remit of administrative review.

now is HO going to send me my biometrix or is still my case pending as i need to book my holidays ?
any sggestion please ?

Have unlocked and combined the posts again

As per the letter, your case has gone back for reconsideration. So, your extension is not approved yet.

Not sure what biometrix you are waiting for.

I had a similar refusal in that 2 part time jobs had different job titles but both had lasted longer than 12 months.

I have applied for AR and i am still awaiting an answer.

No, it depends on the circumstances. Some decisions may be overturned in AR, others get sent back to the team.
