Airport Immigration Problem

Hi guys
I have very serious issue last night immigration officer asked me many question and he felt I am not geniune entrepreneur and he I got my visa extended interview he took 5 hours and checked everything and he said I cant your interview at the moment as you have family and they look not well. and that officer just kept saying I am not satisfied with everything whatever you are saying and he kept saying I have checked all HMRC and Company house and I found 99% false documents.
But I have been paying all my taxes VAT and PAYe everything is update . It seems he doesn't want to be agreed and in the end he said he will take interview after 20 days and if he is not satisfied we will be deported on the same day.
Could any one help regarding this what should I do and my 10 years will be completed in October this year.and he said you will be released for 20 days and this is temprory released and this breaks your continuity as well for 10 years
don't know what to do, he said he will investigate with my previous employees as well
please help any suggestion thanks

Indeed its a serious issue,

You have to go for Interview and clear all the doubts they have..

According to your previous posts you are a Sole trader or Sole Director of a Business and you were away for almost 2 months...I thing that's the point it might raised their eyebrows(this is purely my assumption)...If you have full Genuine documentation and answers for what they are asking its not a big deal for you...

Any such detail, numbers, name or contact information will be deleted and the member issued with a warning.

If you are not guilty of anything and are a 'genuine entrepreneur', then why would you need a solicitor.

But it does seem that if you are sole proprietor and you have been away for so long, that the IO is possibly questioning your 'genuineness'.

What was reason for prolonged absence from UK?
How has business activity been maintained in UK over past few months despite absence?

Hi syed thanks for your reply , he didn't even mention this thing and I am the director of the company and I was looking after from there and I have one employee was looking after here anyway, but didn't to be convinced with any proof or anything whatever I as saying , it looked he had already planned to deport me. but is there any law on interview If I couldnt satisfy him on interview has he got right to deport or he will give me chance to do lawyer?

thanks for Reply CR001 I am the director of the company and I need a solicitor because he doesn't want agree or listen anything it looks like that he wont accept anything anyway now that's why I need solicitor if there is any other way ,

absence reason is some domestic issues , and I have been working from there to help my colleague who was looking after here ..

You do not need a lawyer because it is not a case in a court, it is an interview to check the genuineness in your business, you will not see the same person, he just writes his report, and you will meet another one, if you are a genuine entrepreneur, you can answer all questions, do not be worried, no one can deport you if you have the required documents as an evidence, you are in the UK, but I doubt that you could not explain in English well, so he insisted to ask for an interview, do not worry, do not rush, prepare your documents and answers.

Most unfortunate you could not delegate personal matters rather than disappearing for 2 months or so as your focus, if in UK on a visa, needs to be on fulfilling terms of visa.

My understanding is senior IO may curtail your leave if dissatisfied in your compliance.

I think only reason is you were out of the uk for more than 2 months. Couple of my friends arrived to uk after a month but there were not asked any question.
If you know what you are doing then you don't need to worry,

So first to make sure the docs u submitted are in good shape . And verifiable, also to seek help from your accountant that what documents are false.

Genuine entrepreneurs doesnt mean u cant travel.

They can deport you onlt untill they really found any fake document.

So take a good solicitor with you on board when next time you are having interview.

If u r genuine dont worry .

Hi Jafer He said he will be the one who will take my interview and he kept threatening me that he will proof , but when he said he will proof 99% documents were false , sarcastic smile came on my face it is impossible i submitted all the geniune documents and company is active , HMRC tax are cleared PAYE is upto date Ni is upto date and my english is not bad its very good . dont know whats going to happened

Hi I was out of the country for 6 weeks not for two months , and i invested as required by the policy as Directors loan and showing into my personal and business bank statement and money came from back home and confirmations receipt available as well. he was adamant that he will deport or dont know he was playing blindly ...

i havent submitted any fals documents the dcouments is asking now which are not on policy guidance for example , Employee CV , Advertisement of job, and he needs details of all Creditors and Debtors in the business bank statement and he was saying he will contact all the previous employee who left the company and confirm with them dont know legally he can investigate with third party or not ? i am looking for solicitor who can help me in this matter. its a matter of urgency...

Hellostar, sorry for your plight.

in 2016 I travelled out of the UK 21 times. Twice I returned via Dublin, once from Guernsey and twice more as I am now a registered traveller I entered via EU route at airport. means I met an IO 16 times (and similar amount of travel in years before). Most ask "what do you do as an entrepreneur?" which is answered "my company makes XXX". Sometimes they ask how long have you been away (does IO have access to that data on his/her screen?)

I feel I am missing the big picture here. IOs are not in my mind experts in evaluating entrepreneurs, I doubt they have real understanding of the t1-ent regulations. Did the IO you meet at the desk spend 5 hours with you or did he hand you off to a superior. Could it be you were flagged in the system from before from UKVI and the IO was following up on that?

How exactly do IOs get detailed HMRC data on new years eve?

What stamp did you get in your passport did it day "no employment" and what exactly was the invite to your interview, is it to a UKVI location or back at the airport

To clarify, I am asking these questions to try and help you.

It's not possible to get all details from hmrc in bank holidays. This case reminded me one of my friend who was a student of Manchester university and was a PhD student.
Immigration officer didn't have any idea what PhD is, so he kept asking him that he got scholarship for diplomas.

he kept my passport and gave me a temporary admission letter into the uk and he asked me for the interview on airport with whole family dont know why whole family
he spend half an hour on the desk initially and asked us to sit a aisde he cam back after 20 mins and asked for my tickets and then he cam back one and half hours ad said your stuff will be checked and your finger prints will be taken and they checked each and everything even for my wallet anf even they checked my sons pockets as well
i dont how he got the details from hmrc he might be lying
i dont think so something was flagged because nothing i did wrong i even in the past ..

Does this temporary letter say "no employment"?

What were the first questions he asked (that triggered him to continue asking questions for 30 mins)?


IOs are the front line of keeping immigration policy. But only a UKVI t1-ent specialist would be able to ascertain if you broke the regulations of the visa.

Anything alese in your background? TOEIC? did you ever overstay? Have you been filing self assesmants?

Which country you originally from? It looks like it's security check rather than genuiness check.

These incidents are not that common to be honest. I only faced it like once or twice in several years where the officer was playing passive-aggressive games. I suspect that you failed to provide good reasoning when questioned at the border (not all officers are created equal either!) In my experience none of them understood the immigration rules properly and they were going on a short power trip. The solution is to sound very confident in what you are saying and answer them to the point. If they sense weakness in your responses, then can mess with you.

To be frank your English writing style does not look that great, you made many mistakes just explaining the incident, so I suspect that worked against you. I do not know what triggered him to investigate you and accuse of submitting false documents. You need to go to the interview and see what they are on about. I suggest consulting a solicitor and go to an interview with them if you can. I hope everything ends of being resolved soon.

It seems to be a complex situation and honestly there is something serious you are unable to explain or do not want. I have been out for more than 3 months and even my partner was away for more than 6 months for business purpose but never faced such situation. IO asks question but if everything is genuine then there is no problem. Even if your English is not up to the mark it should be not an issue if you satisfy questions asked by IO. Try to hire a good solicitor and on the other hand gather all required documents to satisfy the queries raised by IO. The time given by IO is a chance to collect the supporting documents and preparation to save your skin. In my opinion documents can be Business bank statements, Accountant letter, etc. Please do not fully reply on yourself and a solicitor & accountant can help you with this. I pray for you
