Post by lema9994 » Wed Apr 01, 2020 8:30 am

hi there ,

Applied Resubmission tier1 extension application 12 November 2019 . some obvious reason 12 December 2019 got biometric date 10 January 2020 . uploaded my application documents 8 of January 2020 , and successfully submit biometric 10 January 2020 on scheduled time .

online application system showed this message
Attend an appointment to provide your documents
and biometrics by 14 January 2020

which I have did well before time ,

ukvi 18 February 2020 refused application as invalid application with below reason

you have not attended an appointment to provide your biographical and biometric information

what steps has been taken so far email to home office to explain we did everything on time , refused me
applied admin review refused 30 march 2020 …
please note that I got full fee and IHS
could you please explain what should I do ? ?

In your previous topic, you were asked to state exactly what the reasons for refusal were. You did not provide this exact information based on the refusal letter.

member/lema9994/posts/

You have also not stated if you submitted an Admin Review for the previous application or not. If you did not submit an AR, then your application in November was way out of time.

You seem to be only applying for visas in order to reach 10 years for ILR.

hi marcnath ,

First of all thanks for your reply on my post ,

What evidence did you have of the biometric submission ?

1- Appointment confirmation letter which download online when I booked my biometric date
Mr xxxxxxxxxxxxxxxxxxxxxxxxxx
UAN: xxxxxxxxxx

2- UK VIASA AND IMMIGRATION DOCUMENTAION referral form
when I visit the biometric SOPRA AND STERIA centre, they gave me this form given to us to fitful our details ,, my passports were already in home office I showed my drive licence as proof identification. this form is also hold details of lady who serve us on SOPRA AND STERIA centre . this is proof I have , attend the centre and successful submit my biometric . that lady told me your biometric successful taken and upload in their system .

Did they provide you the option of AR ?

NO they did not give option for AR . on 18 February when I have received email form home office for invalidation application . my solicitor wrote to home office and posted them biometric appointment confirmation letter and request for reinstate the application
home office replied back on 2 of march 2020 and telling us they are not taking any crosspondance by post any more . they provide us email address to email on that address but refused us 12 march 2020 . inshort they also refused on AR 30 MARCH 2020 ..

Did you submit the evidence proof with your AR ?
Solictor adviser did not attached ( UK VIASA AND IMMIGRATION DOCUMENTAION referral form ) which received from biometric centre . I am surprised as well because he was saying Generally biometric centre did not give any thing to customer .. I think that he did not mentioned in admin review .

Pleasse hep me what should I do next ?????

You seem to have a document that you filled in prior to giving the biometric - how are you still having that document ? I am not familiar with the new system, but I expect that you would have had to hand that form over to the person taking the biometric for them to retain it. Did they give it back to you ? That form does not prove that you "successful submit my biometric "

I would have also expected some document confirming the completion of the process, rather than just the words of "the lady".

On 18th Feb when your application was rejected as invalid, you did not challenge that. Instead you (your solicitor on your behalf) just requested that the application be reinstated.

You were not given the option of an AR, so clearly you could not have submitted an AR and they could not have refused the AR as there was no provision for an AR in the first place. What you/your solicitor submitted was just a request.

Honestly, there are too many questions here in terms of the timeline and the process. I can't see where HO would have made a mistake. For all I know, you went to biometric centre, collected the form and walked out (not saying you did that) without submitting the biometrics - there is no evidence that you actually did other than your word that the lady told you so. And the fact that it was not even raised in your first reply to HO reinforces the impression that it is what happened.

So I can't see what the options are. Your lawyer can ask the centre to provide evidence of your biometric submission - there must be some records about that. Once you get that, you can of course always go to court.

No, you cannot apply for ILR as you do not have continious lawful residence for ILR as you have been an overstayer since Sep 2019. This is not about simply living in the UK. You must regularise your stay, reverse the refusal and get your extension.
And do NOT even think of mentioning 39E: indefinite-leave-to-remain/ilr-10-years ... 81021.html

You can now apply for SET(LR). However, your dependants have to switch to FLR(M) costing you money and they have to start their ILR clock from scratch. UK born baby does not need anything. Register UK born baby as British using form MN1 when you get ILR
