Commercial property investment

Hi,

Exn ext application has been done, amount invested as DL x amount to bus account in end as shortage fund.

After application money of DL has been used for business purpose, also salary has been taken from that DL money to personal account.

Does that salary taken from bus to per account as salarybmakes any different to my application?

Hi, after ent. extension application, if employee change his home address then do I need to let HO know or no need for that ?

AR get refused

Fresh application get refused

Is there any options available after that???

You will have another AR for the fresh application.

Beyond that, it is only JR.

An application has been made

1. Before application company has been set up(it was partnership business before) and new name has given on all paperwork

2. Company has been running well since last one year but due to well known name among customers of old business name new name has not put on board in front of business property

My company and all trading as new company name but just front of business property has got old business name, in this case if I get interview at my office would this impact on my application?

It just adds complications to any interview you will have.

There is a requirement that the company name should be displayed at the registered address, so you should be have the new business name there anyway. (https://www.gov.uk/running-a-limited-co ... l-material)

Reason is old business name has been popular in local community since many years and new name might impact business due to completely different name.

In 2014 july entrepreneurship visa has been granted, I left job that used to do under psw visa route in July after visa granted, an accountant has missed my date as leaver in July, 14 and carried on my payslip for few months even though job has left. While reviewing my history I found this issue which clearly not my mistake and its an accountant. My application for extension is pending since July, 17.

How would this impact my application for ent extension?

The answer is Yes, you are not allowed to work for another company under your Tier 1 visa, so you are in violation of the rules.
You can't use an excuse that it is the accountant's fault. I assume the salary was credited into your account for the next few months, so at the minimum, you were also aware of it.
Question is did you do any corrective actions ? Did you inform the accountant/company once you became aware of it.
Obviously, you were paid money even though you did not do any work for them - did you return the money ?
If the answer to those two are Yes, you should mention that in your cover letter and provide the evidence of the mistake.

Employer was aware of it as I have mentioned my last date to employer and no money was paid as it was payment through cash by employer. I don't know story in between them how they made their communications about my last date. But records show my employment for few months after ent extension granted.

Please suggest if there is any way to fix this issue

I expect HO to have some flexibility in such cases of genuine mistakes.

However, the question is what evidence do you have.

When you say Employer was aware, do you have any written evidence of the same ? Or can you get some such letter now ?
Since you were paid in cash, you can't even show bank statements that would shown the salary payments to have stopped. You may be able to use your tax returns to show that you did not declare any salary beyond your visa date.
If payslips were issued, then employer would have reported that you have salary and paid NI/PAYE on it - at least the tax is something you would have claimed back.
Bottom line - there should be some paper trail that shows you had stopped working. If you can figure that out, it is best to include those and state it up front.
If you can't then best not to mention anything and try explaining it if it is discovered - I am not sure what checks they do. Challenge is that if it is discovered, then your options to correct it are much more limited.

I can certainly get necessary paperwork done from employer for such mistakes. My business was started in Dec, 14 and that business was in loss, so no tax return was done for business for that period. And any salary related paperwork was not done by me as I was not aware of my employment

I was talking about your personal self assessment filing for 2014 - you would have declared your salary, PAYE, etc. You should have also got your P60/P45

But if you have the documents, make sure you answer No to question D9 in the form.

Did look through all documents, serious issues has came that accountant who has done self assessment tax return for 14/15, I have missed to inform him about my income for that period before business started in Dec, 14.

All documents have been reviewed at time of application after July, 14 which was correct but missed few points about tax return done in 14/15.

It seems major mistake, worried about the outcome. Is there any suggestion please?

Not filing your personal tax return correctly is not in itself a disqualifier for your T1E. You should, of course, talk to your accountant about updating that and paying any back taxes if there are.

So your only real issue is the few months of employment which you will have to just hope will not be discovered or your explanations will be accepted.

1. When I speak to my accountant for 14/15 tax return update, I can explain about my employment period salary till end of July, 14.

1. On records p60/p45 shows few months employment after ent visa granted. So when accountant now update on tax return, I will declare my salary till end of July, so figures matches on tax return about salary which is equal to salary till end of July.

2. Accountant update on this tax return would be advisable to do while application in progress or should I wait till the time I get any outcome from Ho?

Please correct me if I'm wrong somewhere

If HO come up with this reason of violation of rules due to employment, would I still get chance for AR and if AR refuse then chance for Fresh application?

I doubt if non declaration of pay would be the reason for a refusal unless HMRC charges you for that.
