Dependant Visa Application

Post by gaga89 » Wed Oct 17, 2018 7:41 pm

Hello Members,

My husband is on Tier 1 Entrepreneur visa which expires in March 2019 and he is eligible to apply for ILR in December 2018.
Myself and my kid are on Tier 1 (Entrepreneur) Dependant visa which will also expire in March 2019.
Me and my kid can apply for an extension in February 2019 (not more than 28 days before expiry date) and my husband is applying for ILR in December 2018.
Below are my questions:
1. What documents should I provide for my Dependant extension if my husband does not get his Biometric card before February 2019?
2. Can we all apply (Me and my kid for Extension and my husband for ILR) at the same time in December?
3. Any idea what will be the expiry dates for me and my kid, is the extension given for 2 years or 3 years?

Many thanks in advance.

When are you completing 5 years ?

Was you kid born in the UK or home ?
1. Copies of existing BRP. Your extension will not be approved before your husband's application is decided. It will be pending until then.
2. Yes, you can
3. It will be three years

Thank you Zimba and marcnath for the reply.

My kid is born in India.
Myself and kid will be completing 5 years in 2021. Our current visas will expire in March 2019.

Regarding the below Question
"Can we all apply (Me and my kid for T1 Ent Dependant Extension and my husband for ILR) at the same time in December 2018?"

In Home office website, it is said not to apply for any visa/extension more than 28 days before current visa expiry date.
Does it apply to my T1 extension case?

And again for confirmation, Can I provide my husband's current BRP (Expires in March 2019), when I apply for T1 extension?

Many thanks.

No need to provide anything

Hello Members,

In the below link,

https://www.gov.uk/tier-1-entrepreneur/family-members

I can see two different links for Tier 1 Dependant - Spouse and Tier 1 Dependant - child application form when applying online.
apply online - dependant partner application
apply online - dependant child application

And only 1 application form for paper form(below link)
https://assets.publishing.service.gov.u ... -06-18.pdf

We will download the paper form application as we will be using the postal service.
Do we have to fill the same application form (2 forms, 1 for Dependant Partner and 1 for Dependant child under 18) for Tier 1 Dependant - Spouse and Tier 1 Dependant - child?
Or are there different application forms (paper forms) for Tier 1 Dependant - Spouse and Tier 1 Dependant - child?

Many thanks.

If they are applying together, then you use one form

Hello Members,

I(Wife) am applying for an extension as a Tier 1 Entrepreneur dependant and my husband is applying for ILR. We are making an application from inside UK.
I (Tier 1 entrepreneur dependant) have few questions:
As I am applying for visa inside UK, Do I have to provide any Criminal Record Certificate (Criminal Record certificate from India, detailing for past 10 years)?
If Yes, how can I get the criminal record certificate for India from UK?

Thanks in advance.

Many thanks for the reply Zimba.
However, I have been away from UK for more than 12 months cumulatively from 2014 (when I first got Tier 1 Entrepreneur dependant visa) till date.
I was away from UK (In India) on these below dates:
December 2014 to April 2016 - 16 months
January 2017 to May 2017 - 6months
May 2018 to July 2018 - 3months
I will be applying for an extension of T1 Ent dependant application from inside UK, next month.
I found the clause on UKBA website to provide Criminal record certificate for the past 10 years, if away from UK continuously or cumulatively for 12 months in the past 10 years.
Is that clause applicable for my situation?

Thanks in advance.

There is no UKBA it is UKVI :!: Also the Criminal record certificate applies ONLY to entry clearance NOT extensions

Read the guide: https://assets.publishing.service.gov.u ... 2.0ext.pdf

Hello Members,

I need a clarification on the below scenario.
I am on T1 Ent Dependent Visa (Wife) and applying for extension as I am not eligible for ILR yet.
My 3.5 year old kid is on T1 Ent Dependent Visa (Child) and applying for extension as he is not eligible for ILR yet.
My husband - T1 Entrepreneur visa Main Applicant is applying for ILR.

As per the application form, ILR and T1 Ent Dependant extension forms have two different addresses.

For ILR:

Home Office
SET(O)
Indefinite Leave to remain
PO Box 591
Durham
DH1 9FS

For PBS Dependant Extension:

Home Office
Tier 1 Dependants
PO Box 496
Durham
DH99 1WQ

We are all applying together at the same time through postal services from inside UK.
What address should we send our applications to?
Should I and my kid send separately to Tier 1 Dependants
Or We Send together with main applicant to SET(O)?

Thanks.

It shouldn't matter. HO will handle it - just be clear in the cover letters.

Most people send both applications to the SET(O) team.

Many thanks for the information marcnath. As advised, We will send all applications to SET(O) explaining the details in Cover Letter.

I have a query regarding IHS.
I was about to pay IHS today. I filled my (T1 Ent Dependant - Spouse) details and it asked the details of the main applicant and dependant (I filled in my kid's details).
Our Visas will expire on 26 March 2019.
My husband has not got ILR as we are all applying together.
ILR application for my husband, T1 Ent Dependant extension applications for me and kid.
Please advise on What should I fill for the expiry date of Main Applicant(T1 Ent - My husband).

Thanks.

Hello Marcnath,

I am applying for extension for 3 years as my current visa (T1 Ent Dependant Partner) will expire on 26 March 2019.
My husband's current visa (T1 Ent) will expire on 26 March 2019 and he is applying for ILR. We are all applying at the same time, from inside UK.
I need to pay IHS for my extension period of 3 years, so how can I fill My husband's expiry date as 2019 again.

Many thanks.

I think I have seen others mention a similar case. If there is an option to say that the main applicant has ILR, then choose that (while strictly not correct, your application will only be decided once the main applicant has ILR) Otherwise you can only fill in the current expiry date and I think you will get a zero fee, They will contact you later to arrange payment.

Thanks for your reply.

I need a clarification on the below scenario.
There are 2 links to apply online as PBS Dependant Partner and PBS Dependant Child.
I am filling out my PBS Dependant Partner application. It is asking me if I have any additional dependants (For ex.,kids). Should I fill my child's details here? Or should I use separate 'PBS Dependant Child' application for my child?

Many thanks in advance.

If applying together, you should add the child to the partner application

Many thanks for your reply marcnath. I will do that.

Can you clarify on the below.
I have paid IHS and have received 2 separate IHS numbers for me and my kid. So, if I add my kid as additional dependant to my PBS Dependant partner application, Would there be a provision to enter 2 different IHS numbers?

Thanks in advance.

I don't know all the online forms and I am not going to go through those myself.

If the form asks for it, you will provide it - if not, you don't. As simple as that.
