Evidence Flexibility more flexible than 245AA

Post by Obie » Wed May 11, 2016 2:18 pm

In a helpful Court of Appeal guidance, it has been ruled that the Evidence Flexibility policy is widely extensive than 245AA of the immigration rules, and the tribunal erred in adopting a narrow approach.

SH(Pakistan) is a very helpful case, and will assist those who were refused due to absent document or slight deficiency in the document provided.

How likely is this decision to affect the actual processing of current cases? My application is currently being processed and I have seen that many people were rejected on similar grounds (missing or incomplete documents) by HO.
