Thanks you again. To be clear, if i withdraw the AR and put in a new application on FLP will i still become an overstayer?

Yes, you become an overstayer if you withdraw your AR or submit an FLR fp as your AR will automatically withdraw if you submit a new application.

Please help. So does it mean the only way i could have maintained the continous residency was to make a fresh application and not AR?

I am sorry i post questions as they come. So assuming i make a new entrepreneur application can i use the old bank account and jobs created for the previous application to make a new application?

Ok. Just to be clear again. If i withdraw the administrative and put in a new application, even if granted a visa under FLP i loose the 9 years.

But if i allow the administrative review decision to be made and make another application on the FLP route withing 14 day and get the visa i secure the 9 year?

If you secure ANY visa, your period of overstaying will be discarded. However If you are refused, your continuous stay will be broken

If your AR is refused, you become an overstayer. You get 14 days to apply for a new application.
If you withdraw your AR, You become an overstayer. You get 14 days to apply for a new application.
If you do NOT withdraw your AR and apply for a new application, your AR is automatically withdrawn and you still become an overstayer on that day.

In ANY of these scenarios, your new application MUST be successful (you MUST regularise your leave) in order for your lawful residence to continue.

Secondly at what point does my continous stay break and i loose it all? Because what i am getting here seems to mean if i secure a visa even on FLP i dont break my continous stay.

I repeat - I cannot advice and nor can anyone else in this forum. A lot of things depend on your personal circumstances and would need information that is not available or can be shared here.

So even if someone else offers an advice as to what you should do, be careful as they will be advising without full information. If you can't decide yourself, go to a professional service for help.

In general, the best option is to meet the requirements of the route you have your visa for.

It means new application MUST be successful. Your continuous lawful residence breaks if your new application is refused.

Thank you all for your support here. So my review was overturned and visa granted. Apparently it was based on the fact that i met the criteria for creating 2 jobs for 12 months.
