Post by waqas734 » Thu Mar 10, 2016 1:28 am

Hello to all members ,

I have successfully extended my tier 1 entrepreneur visa , received my BRP in less than 10 days after my biometrics , Ho doesn't seems to harsh as we hear now a days on applicants at least in my case if one fulfils all the requirement and submit the require documents according to the guidance than the process is very smooth and quick . I wish best of luck to all the applicants whom application is under process or submitting their application soon :)

Following is my timeline

Application Sent : 11/02/16
Application rec : 12/02/16
Fee Deducted : 15/02/16
Biometrics Given : 29/02/16
Visa received : 07/03/16

i used solicitor to represent my case and i would recommend to always use solicitor and represent with good covering letter even if the case is straight forward as it does make difference in the end and case worker thinks twice to refuse the application on minor issues if application is coming from good solicitor .. i have seen members who applied on their own are either refused for very minor issue or still waiting for the outcome of their application for than 3 . 4 months

Congrats on your visa extension. I disagree that you need a solicitor representation for a successful application. HO grants visa strictly based on Immigration Rules not whether you are represented by a solicitor or not. In fact HO does not really care. Many Visa applications are straightforward and HO does not have time or resources to investigate every visa applicant. If your case is straightforward, sent all the required documents and your personal/immigration history is clean, you have a good chance of being granted visa quickly.

Hi Zimba
I was going to comments that i am confused whether i should hire solicitor or not after his successful application because he is saying its better to go with Solicitor while we can do everything but he was sharing his good experience
i think we dont really need a solicitor , good and professional experience accountant is a good option instead isnt ?

My only source of disagreement was the unfounded claim that being represented by a solicitor somehow influences the HO decision making process. There is no evidence for this claim, as any Visa refusals/grants are strictly based on immigration rules. Many members on this forum had solicitor representation and failed to extend because they conveniently left everything to their solicitors. In several cases observed here, the solicitor failed to do basic checks for the existence of mandatory documents required by Immigration Rules. In few cases they even gave wrong advice to their client, even contradicting the Immigration Rules.

Please remember that it is entirely your responsibility to ensure your application has all the documentary evidence and information, required by HO. Simply relying on a solicitor for your extension is not enough. My suggestion is that you better be involved in the process and make sure you understand it quite well. At the end of the day, it is up to you to hire a solicitor for extra help and reassurance but there is absolutely NO influence they can exert on HO visa decision making process

+1

Very sound advice. Ignorance is no excuse either in business or in immigration matters.
An honest mistake in an applications may be tolerated (once) but still risks impairing the case and one's chances of success.

The UK immigration system is by nature rule-based and procedural and impersonal.

Personalities don't come into the equation.
Any kind of approach that simply relies on blind hope and 'hot shot lawyers' or 'specialist advisors' with "good experience" (for example, in TOEIC cases or tax discrepancy cases or whatever the bone of contention happens to be) seems to be a fundamentally flawed approach.
Whatever the outcome such representatives always walk away with their fee, the applicant still carries the can and any legal responsibilities.
All that is gold does not glitter; Not all those who wander are lost. E&OE.

Partial refund was issued same day as my visa processed on , which was 7/02/16 . I don't think they issue partial refund week or two before , it normally comes back into your account on the day the decision was taken or day or two before but again some people might have different experience , me and my another friend with his individual application experienced same pattern we applied almost same time and received our visa's with just a day difference but his application was initial one and mine was extension

So you actually saw the partial refund in your bank account before you actually received notification that your extension was approved? (I'm assuming that even though your extension was approved on the 7th, you didn't find out about it until you got the letter a few days later)

Does everyone have to pay the surcharge for 3 years? And then one year's refund is issued?

Following are the document list I submitted ,

1 - Application Forms
2 - Passports
3 - Previous BRP
4 - Funds Maintenance Bank Statement
5 - Companies House Certificate
7 - Current Employer liability insurance Insurance certificate
8 - Pay slips of all the employees
9 - FPS for each submission (Signed by myself)
10 - Business Bank Account statements (I invested 50K in 20 instalments with various different amounts, therefore only statements attached where it shows Investment amounts)
11 - Personal Bank Account statements which shows investment transferred to Business Account
12 - Director's Loan Agreement
13 - CA cover letter
14 - CA letter which confirms each and every employee number of hours, hourly rate etc
15 - Business visiting cards, Letter heads and little more stationaries.
16 - Three years Annual Accounts (Make sure to sign these annual returns)
17 - Self assessments reports
19 - Corporation Tax final summary report
20 - PAYE final summary report
21 - Payslips of all the employees
22 - Passport copies of all the employees
23 - Address proof for all the employees

My solicitor made sets of all the employees individually with a cover letter for each of them explaining the number of hours each month they worked, hourly rate paid, their start date or leaving date FPS copies in their particular sets. Also explained in the covering letter refereing all the refusal points and explained why we don't fall into these sections

Thank you so much for the list.
Did your loan agreement state that you would transfer the money in instalments? If yes, did you specify when, i.e. the first of every month for twenty months, etc?

yes all the dates we transferred money into our business bank account were mentioned in the director loan and supported by the personal and business statements we provided , and we also highlighted the transactions in the statements for the caseworker ease .

Hi Waqas,

I have couple of questions. Can you please answer.

Did you also sign the each and every Payslip ?
Did you just sign or also put the Full name on the FPS..
You said that you submitted the three years full accounts...Did you make the investment into each and every year of the submitted accounts ?

what date did you put on the DL...the one when you got your initial visa or the date just before making the first investment transaction ?

Thanks in anticipation !
