Hi

This maybe repeated question but I got in contact with one advisor and he said that

EEA dependant (spouse) will not be considered for job creation.

I saw in guidelines it says will be accepted but we need to submit marriage certificate with it.

A)
In my case the employee received the visa on EEA spouse (living together partner) but he hasn’t got marriage certificate.
So will he count towards job creation ?



B)
Is there someone got extension visa whose employee were on furlough ?

Coz I still can’t be 100% sure that they can be count in job creation.

All people under EEA regulations are considered settled
“Settled worker” means:
(a) a British citizen; or
(b) a person who is resident in the UK in accordance with the EEA Regulations or who holds a permanent right of residence in the UK in accordance with regulation 15 of the EEA Regulations; or
(c) a person with leave to remain or indefinite leave to remain granted under Appendix EU; or
(d) a British Overseas Territories citizen, except those from the Sovereign Base Areas in Cyprus; or
(e) a Commonwealth citizen who has been granted permission on the UK Ancestry route on the basis that they have a grandparent born in the UK and Islands; or
(f) a person who is otherwise settled within the meaning of section 33(2A) of the Immigration Act 1971.

Investment fund question

Hello everyone

I m on 200K route and my questions is

Do I have to transfer the fund from the same account I have declared in my initial application in india.

Or can I transfer it from any account to my uk account ?

For example:

I had 200K in my Indian account in my initial application
So do I have to transfer all the amount from my Indian account to my UK personal account to make investment in my company ?

Or can I take gifts or loan from someone in UK to make investment in my company ?


The reason I am asking is because my wife has savings of some fund in uk so
Can I take money from her to my personal account and invest them in company ?


I was looking for clause where it says all the fund has to be transferred from other country to UK but I couldn’t find anywhere so wanted to make sure about it

You simply have to show that the funds came from you. There is no cross-check with original account

So that means it doesn’t matter where I get money to my account as long the money goes from my personal account to business account.

Am I right ?

Has anyone experienced this kind of situation for extension ?

before 19 November 2021, the investment must be shown through readily identifiable
transactions in your business bank statements, which must clearly show the transfer of this

preparing for extension

Hello everyone,

i have few queries,

1st my company address is registered to our store address instead of my home address.
is it advisable to update it to my home address ?

note: my name is there so i don't think so there will be an issue but still do not want to take a chance.

2nd
when i submit job creation evidence do i need to submit payslip and docs for the all the employees or for the only which i m claim to create jobs.
note: i have 2 british employees, 1 european, 1 european spouse and other is indian passport holder.

asking as they all have different roles and some have similar roles too
eg. sales

3rd
is it advisable to be dependant on furloughed employees who were paid full wages while they were on furlough ?

1 - can't see why you would need to change for your application purposes
2 - only need to submit those that you are using for your points
3 - don't exactly understand the question but yes, you can use your employees on furlough for job creation

Hello guys

I have extension in July 2022 and so far I have managed to invest 180k in my company but my store IESBT need any further investment unless I do overstock of few items.

So I am thinking to open new company where I can invest about 40 to 50K before my extension.

My queries are ;

Is it advisable and acceptable if I open new company ?

Can this investment will count towards my total investment ?

I have already 3 employees in my old company so I will the only one on payroll of the new company which should be fine. Correct me please.

Also can the director be on payroll for full time ?

Is this amount can be count towards investment ?

You don’t have to ‘invest the 200k’ but you should show that you had access to them in one shoot. I would assume if you already invested the 180k you must have had the 200k at any point in time? Or did you do piece-meal money transfer? Best of luck!

You seem to have misunderstood the meaning of "investment". There is no requirement that the money needs to be used to buy stock or anything else. If you transfer to 20K to the business bank account either as a Director loan or Share purchase, you meet the investment requirement.

I have made the transfer to the business account as a director loan.
Thank you for the advice.

Question about job creation :
Maybe it is repeated but wanted to take the views of the members and moderators ;

I have few employees and I am going to claim point for :

1) British employee who had worked for 13 months
So her job will be counted.

2) European employee who got ilr so she will be counted as well. She is working with us atm since about 8 months.

3) spouse of the European member (his wife has the ilr) and the guy has Indian passport and got visa as europeon dependant.
-) some days he will be counted and some says he won’t be counted.

Will he be counted towards job creation as he has been working with me for more than 2 years.


So I have 3 employees where I can claim the points for job creation.

Please correct me for the above employees if they will be counted.


Question number 2

I have been taking salary from my company as a employee since beginning about £700 a month which is 80 hours a month.

So the amount has been taken as my salary can be excluded from the amount I have invested ?

The reason I am asking because I m about to take slight more salary in few months time.
Will it be advicable to take full time salary from my company ?

Or I should leave it till my extension which is July 2022.

I have 4 employees full time who are settled.
And 2 are part time who are not settled.

1) only need to submit documents that you are claiming for. Incidentally, some documents (FPS, for example) will include all employees anyway.
2) "(iv) if the employee is an EEA national, a UK registration certificate/permanent residence document" is the requirement
3) All leave to remain applications have to be made before expiry of the current visa - whether it is yours or dependant's

Just remember that they often look at the timing of the cash flow into your company. So it is not about the annual salary being less than the annual revenue, for example. If you are paid on a monthly basis, then the revenue will be looked at monthly also.

In my case
My company generates revenue of about 15k a month
And director salary is about 1000
So I guess it should be okey.

And that’s how it has since open the company.
