PBS Dependent query - confused

Post by sky_rise » Tue Jun 08, 2021 12:59 pm

Hi members,

My partner is on the PBS Dependent visa, which she got 4 years ago when I was on T1 Entrepreneur. Since then I became a BC and she needs another extension for one year to complete her 5 years on this route.

I am confused what are the new requirements for this, and whether there is an option to extend for just one year, not two. She initially got a PBS dependent for 3 years in Oct 2017, but had to renew in Oct 2018 when I changed my status. She is eligible to apply for ILR on 5 years in Sept 2022.

I am confused whether there is a different application process now from what we have followed, and document requirements, like:

- Proof of cohabitation? (we own a house together etc)
- Proof of my income (us that £18,600 p/a)?
- Maintenance funds for 3 months (£650?)

Thank you,

SR

Extension under the PBS route is always for 3 years, it cannot be shorter. You only need to show maintenance for her

Thank you Zimba. I am a bit lost as so many changes were made. I am reading on Gov UK and it is confusing between a family visa, spouse visa etc. I can not seem to find the exact guidance for this type of extension. There used to be a PDF form available. Could you please point me in the right direction?

thank you,
SR

She is still under Tier 1 PBS dependant route and will remain so. Ignore other things.

thank you. If I understand correctly, the fee for in the UK application is £1277 + NHS surcharge for three years + the biometrics fee. If we both have been in the UK for over 12 months - there is no maintenance requirement to prove?

Correct
thank you Zimba. Does it make any difference whether I or my partner are employed/ our financial status at all? Foe example, she just turned a freelancer and I am changing jobs with a few months' break in between.

Thank you Zimba.

Can I just confirm that the checklist would be;
- Current and previous passports
- completed application form
- marriage certificate
- cohabitation evidence for the past 2 years (banks statements, utilities, mortgage etc)
- current brp

That would be it?

Thank you,
SR

hi members, I have a quick question.

My partner will be applying for a PBS dependent extension in October. basically, she only needs a visa for less than a year, and not the standard offered 3 years. There is a cray cost to pay towards IHS (when did this balloon to this crazy amount per year??). Almost £2000 additional cost (mental when you think that a person is working full time, paying NIC and all other taxes etc!).

Any advice welcome is there is anything to reduce the number of years required on the visa and associated surcharge.

Thank you

Unfortunately not. The immigration rules state it will be a 3 year extension when the main PBS visa holder has got ILR. There is no discretion to shorten the time it is granted for.

many thanks for this.

When we start filling in the form, it asks about immigration status of the person to whom the dependent is linked, incl. SOC code of the occupation. How is that relevant, and is that the current code of the job or previous one pertaining to the times of being on the entrepreneur visa (3 years ago)?

thank you!

thank you, that's helpful.

Another question asks about medical treatment in the UK. We have private medical insurance, for which we pay, for the past 3 years, and used this a lot. Are we supposed to give all the information on the form about treatments? pretty much impossible to figure out the dates when tretment started/ended, as we do not keep in, nor does the private insurance firm (they just pay the bills).

thanks!

there is a question specifically asking whether we have received medical treatment in the UK, with simple answers Yes or No. If you answer yes, it starts asking you have you paid, when, what are the dates, addresses of hostitals etc. The only option to avoid this is to answer No, I haven't had any medical treatment. So, what should one do?

thank you. This is a really strange application form. I have another difficulty there.

We have completed the health part of it and went on to continue to the immigration health surcharge. It keeps asking the following questions about the main applicant (me, BC now), before letting my wife proceed with paying IHS:

Missing Details:

The person you’re joining or remaining with in the UK
Add their visa expiry date

I have no visa expiry date, completely at loss what to write here. Does not let us continue...

Please help what to do here?

Put a date 3 years in the future to get the correct IHS fee.
