If your new application is successful
I repeat - I cannot advice and nor can anyone else in this forum. A lot of things depend on your personal circumstances and would need information that is not available or can be shared here.
It means new application MUST be successful. Your continuous lawful residence breaks if your new application is refused.Bigyou wrote: ↑Mon Dec 09, 2019 7:43 amThank you for this. Please can you explain the bit in brackets ( you must regularise your leave).
Secondly at what point does my continous stay break and i loose it all? Because what i am getting here seems to mean if i secure a visa even on FLP i dont break my continous stay.
The letter must have also given you some options. Have they curtailed the visa that you have been issued ? Have they indicated that you have to leave the country ?Bigyou wrote: ↑Mon Mar 30, 2020 10:12 pmPlease help!!!
After i was given a letter by the home office that my visa was granted and documents returned, i never received BRP card for 3 months. I followed up by chasing for the card and have been told the Visa was issued in error.
3 months error is just too costly! I don't know if it makes me an overstayer because i applied for an admin review after the initial refusal and varried with my son's application.
The visa was given based on the admin review and both applications were neatly returned with my other documents which i used to apply and now i am being told it was done in error.
Please what will be the best way to approach this? I am exhausted with finances and getting new contracts has not been easy with all of these home office issue. I do not know if i am an overstayer or not.
I intend to get in touch with my MP as the home office needs to admit they made a mistake by not sending my card instead of all these.
Please sorry for the long post i just needed to look at options around me. Which are
1. Should i put in another application in my son's name as a dependant on him?
2. Should i ignore all and contact MP?
3. Should i write home office to highlight point which was raised as reason for the grant in the letter of approval?
4. Should i go to court?
Please i would appreciate as much advise as possible. I dont want to limit myself to advise of my lawyer which is all about getting money at all cost from me.
Thanks
Thank you i will take this advises given. I will have to use every option available. It is very ridiculous.zamaha wrote: ↑Tue Mar 31, 2020 12:47 amHi
So sorry to hear about what happened with you.
Probably senior members and moderators can help you better with this.
But if I were you, I was going to contact my MP straightaway. Explaining everything in detail and asking for help.
Also, I would write an email to HO complain department and tell them that it is not right that after 3 months of chasing and keeping me in dark, while I was told that my visa was granted now I have been told that it was an error. Ask them for their help and as it is an exceptional situation and not your fault, ask them what your option will be and how long you have until you can make your next move.
In my own experience, they are replying to the email faster and more helpful.
Hope everything sort out for you.
Thank you very much. In all honesty i would say the writer was very ignorant of the approval.marcnath wrote: ↑Tue Mar 31, 2020 2:03 pmThe letter must have also given you some options. Just a letter saying it has been granted in error without any indication of what it means to you does not seem to make sense.
Options were not given. No reference to what the 3 months of error means. They did not say i have to leave. Nothing written regarding my stay except reference to the refusal being the right decision they made.marcnath wrote: ↑Tue Mar 31, 2020 2:03 pmThe letter must have also given you some options. Thank you. Exactly my point too. For the first time a letter from the home office had an error on the case number and refusal date. Highly unprofessional for an organisation such as the Home office. I have lawyers on it.
