Questions about job creation

Dear all,

Hope all of you are well.

I am recently planning to start with hiring two employees. I have two candidates who are good at the job, but they have different status in the UK.

1. First candidate has recently became British citizen, but his passport has not been issued due to covid-19. He can only provide citizenship proof for now.

2. Second candidate is spouse of British citizen. I saw on the immigration rule spouse of EEA citizen can count for the job creation, but no sure about spouse of a British citizen.

I appreciate for any advise on whether I can start the employment with the two candidates stated above.

1. Fine to use. Passport is only a travel document.

2. Doesn't qualify if holding a spouse visa under the UK immigration rules. They are not considered a settled worker.

So the spouse of EEA citizen can be count as a job creation ?

I was looking for the link but I couldn’t find it.

Yes, a spouse of EU (non British) citizen.

It is in the tier 1 guidance notes.
