Congrats Goblin, finally things start moving for all of us. What a feeling when you get hold of your BRP!

Don't worry about the fee, I had the same situation but got the refund after a few days of BRP.

Hi

The HO would of been given I think it is around 5 working days to appeal against the decision - if they didn't (you can ring the FTT to find out) you only have to wait for them to send the docs back - hopefully it doesn't take long! Congrats

Goblin wrote:It's been 12 weeks for me since my appeal was allowed. But I haven't received any refund either. I think when they process your application it's then when they refund the appeal fee. But hard to say anything coz some have got their fee refunded and are still waiting. I am waiting for everything. Can't wait more but can't do anything either. And I guess there is no harm in calling HO to ask for status update it doesn't hamper the situation. But in your case (smartpen) your solicitor might have asked you to wait coz it's just been 6 weeks and usual wait time as per HO website is to wait for 8-12 weeks before contacting them. Until it's an emergency. So I guess if there is no rush you can wait and contact them later. I contacted HO after the 8th week passed and will do again next week.
Hi Goblin

Could you advise me on the contact nrs/ emails you used to contact them?
Much appreciated

Im not sure - I think I have it written on a doc somewhere - Ill have a look. It was definitely confirmed by the FTT - if you ring them and follow up with them Im sure they will advise you on the timelines

After the HO appealed against my appeals decision and the FTT didnt allow their application I rung the FTT every day - the lady said that if by the next Mon they didnt hear anything from the HO thry would miss their deadline to appeal again :D

Again if they have to appeal, what date it could be considered
Date on the decision letter from FTT or the date when we receive
Sorry this period is more stressful than anything else. That's y I am asking too many questions

Im not sure - but Im putting my hopes on the date from which FTT didnt allow their application to the UTT.
My appeal was allowed on 20 Nov 13 - then the HO applied to appeal on 29 Nov 13 - i got the letter from FTT saying they didnt allow the HO applivation on 11 Dec. Im using 11 Dec as the date

So for me next week 11 March it has been 12 weeks with no further news!

Hi aodendal
Tq. I am a bit confused. "The date From which FTT didn't allow their application to the UTT". Can you pls explain what happend. Also appeal allowed means is that the date you received your letter from FTT?

Hi aodendal,

I had been calling at their General Enquiries Number 08706067766, extension 2.
But if it is an emergency you can even fax to the case working team - 011420725361, mentioning your reason and asking them to expedite your application. But obviously, it's up to them to consider or not. But you can always send by explaining your circumstances properly. As I see you have been waiting long. But Call that number first and ask status of your application. Hope it will help. Good Luck.

Hi dancingguy05

Sorry these things are sometimes a bit confusing!
My appeal was allowed on Nov 20 - on 2 Dec I received a letter from the first tier tribunal saying that the home office had made an application to them for permission to appeal their decision at the upper tribunal, and would have to wait for an outcome in writing.
A week later - on 11 December I received another letter saying that the first tier tribunal has declined the home office's application to apply to the upper tribunal

I'm using this letters date (11 Dec) as the date I'm counting my "time waited for the visa", instead of the 20th of November when the appeal was actually allowed as it would have been pending as they tried to appeal the FTT's decision

Hope this makes sense! lol

Thanks Goblin!

I contacted them an (of course) their answer was that the visa is "in process".
Ill wait a few days to see what happens - as I have my MP on the case as well - and then fax a letter

Hope you have a good weekend - you have loads to celebrate!
