I was wondering if you could shed some light and give your opinion on my situation as I am aiming for the fast track route (10 employees)(200k route)
My situation is as follows:
Investment
40000 in a restaurant (Ltd company)
160000 in two retail businesses (sole proprietor/trader)
Employee
part time and full time total comes to 7 employees and would be completing another 3 before I go for my extension in 2016.
Question.
1. Do the businesses have to be making a profit ? (all three are in the red, there is potential for making a profit but could be after a few years before they start making a profit, again just potential no guarantees) Do you think UKBA cares or is concerned if the business makes a profit ?
2. Might be selling the restaurant, the money I receive will go to the LTD company account, do I have to reinvest this money or if it sits in the company account not doing anything and also the company not doing any business would be fine?
I do understand you are not an immigration adviser but just want your opinion as you have recently gone through a successful extension process.

Actualy, if you guys can advice about the investment and director loan it would be great.

I 've got my visa last year August and I tranferred 50 k after 1 week when i got my visa.My business nature does not require full amount of 50 k investment.My query is if i just spend 20 k out of 50 k and rest of the 30 k keep as a unsecured director loan in business.

Should I get the 20 points when i will go for an extension of invested funds.

The above has already been answered in this thread but just to maintain the sanity, here is what Rahul posted earlier.

Also- for all the people who have questions about investment money and how it should be spent.

We only transferred 200k from personal bank account to business bank account. thats it.

We did not spend even 1 penny from this pool as our business had revenues from the 2nd month and was profitable every single month after employee/admin costs, so there was no need to spend anything from this 200k. It just sat there the whole 3 years without much use(which is a shame).

UKBA are not fools as we think, they understand that businesses do NOT not spend money if NOT required.

For them the meaning of investment is that you have transferred money into the business bank account. Their line in the guidance which says that money should not sit idle in the bank account and should be used actively- I think it is for applicants in the property business. It did not affect us.

Hello Rahul,
I'm on 200k category, I'm going for accelerated route and applying for ILR in 1st June. 2015.
Well I'm operating 2 businesses as a sole trader the lust u mentioned is for limited company ....
What about my situation could u pls help.
All funds came from back home into my personal account itz an account to account transfer.
I did major transitions from my personal .

Could u pls share the list for my category as sole trader pls.
And pls do share what u provided them as advertisement proof.

does my list say I have advertising docs ?.. It rather clearly says that I 'only' submitted the below. Then why do u assume I submitted it ?

Plus I have also said in the thread that I 'cannot' help anyone outside my straight fwd category as I do not know what is required. me advising you would be wrong as I am not an immi adviser.

Pls READ the thread, and READ the guidance! All answers are there.

Most recent question was - May I know how much amount you have run the payroll for the employees monthly wise(hourly)?

Answer:

As long as you pay them above minimum wage / hour ( https://www.gov.uk/national-minimum-wage-rates ), you should be fine! We paid one of our employees at min wage- and it was fine.

Doing the maths for you:

At current minimum wage the salary for an employee per year will be

(£6.50/hour) X (30hours/week) X (52 weeks/year) = (6.5 x 30 x 52 ) = £10,140/year

So per month = £10,140 / 12 months = (10,140 / 12) = £845/month (gross)

Remember, you need to re-calculate and annual/monthly salary and change/increase it as the minimum wage goes up Every year in October.

Dear Friends;

I seen so many posts regarding invested funds proof and lot of guys trying to confuse others regarding this. In policy guidance i cant find HO require personal bank statement showing amount transfer in company account all HO need company annual accounts with director loan agreement and accountant confirmation. whats your take rahul and all others who got extensions.

Dont think you have read all the posts-

in my posts in this thread, i have mentioned that no bank statements required

Please do not overdo it.

It simple plain paper and no solicitor nothing required, like any agreement for a loan. A bank loan in the UK is printed on plain A4 paper. Just print yourself and sign and retain, thats it.

If you overdo it, then it puts pressure of expectation from other applicants and the case officers start to expect that. Plus the case-officer will only check what is only necessary to satisfy an audit later, and not look at all the fan-fare extra docs. remember, no one wants to do more than what they are paid.

Do not provide extra unnecessary docs which have NOT been listed. Just meet the bare minimum.
You will notice that we did not even provide company bank statements! Why ? Because it was not asked for. Only letter from bank was enough. So again, stick to bare minimum, enough to tick the box and you are sorted.

The UK visa system is a tick box system, if you tick all the boxes you are in good shape. Too much information works against you. its my 2 cents from experience.

So keep it simple

In my opinion you can either give the three month bank statement or give a letter provided from the bank.
Some banks are not happy providing letters.

cappachino - you are confusing him

He is asking about demonstrating investment - For that you do not require anything - Nor bank statement, Nor letter from bank.

see my document list for investment - Nothing from bank required!

6) Cover letter from accountant, that he has done the accounts and that we have invested £200,000 into the company via director loan

For company creation and running - yes you can provide a letter OR you can provide just ONE bank statement, Its all in the guidance very clearly!, no rocketscience help required.

- Its not maintenance - so 3 months not required.


I have said before, dont over do it, as First, you will make it difficult for others, Second, you will attract more questions on your own application, which I am sure you do not want.

Hi rahulsingh1, Thanks for posting such a comprehensive list. Can I ask why you submitted management accounts for 3 year period?

It seems there is no mention from the Home Office on the period the management accounts should cover.

I only invested the money (via a directors loan) in April this year. I received my visa in Jun-2012 and it is due to expire in a few weeks.

Do you think I need to submit management accounts for the full 3 years. My interpretation is that it only needs to show the investment of the required funds, so just the last 12 months should be sufficient.

You might not have the answer but I'd value your input and thoughts as to why you chose 3 years. Perhaps you invested your money in your company at the beginning of your visa period, which is quite different to my circumstances.

you answered your own question.

But its better to submit from beginning(no harm), as it will show the total activity of the company in the whole period that you have held your visa.

My Questions are as follows, Can Any one Answer Please?

/////3 Years Accelerated Route....£200K Route......//////

1. Do we need to supply Invoices/Bills for every Transaction?

2. Do we need to supply proof of the £200K in the form of expenses that investment has been done. For 10 employees nearly £100K gone for salary/expenses? Can director salary be also shown as acceptable expanses?

3.Do we need to give rent/electricity/gas/business rate/water/insurance bills RECIEPTS?

4.If 2 employees working full time 60 hrs per week for three years, can they add up to make 10 employees?

5.If one entrepreneur team member got seperate in the middle from Ltd Com how to show it?

1-Currently,they are not asking for even business bank statements and you are gone to invoices,They are not accountants to do your accounts your accountant has to do this and to confirm the investment.although this could be asked by HMRC or if you are called for interview(in case they are doubtful about the investment or genuineness),but till date no invoices to be produced to Home Office.It is very likely that they request Business bank statements in near future,
2-Salaries are counted as investment so there should not be any issues.
3-Directors salary would be part of expense in annual accounts but for Home office accountant has to deduct it (thats what I think)before certifying net investment.
4-Your 2 employees for 3 years would count towards 10 employee creation but you definitely need more.(10 employees=120 months of full time employment)

Congratulations on your application. Can you tell me if you had to show any proof for all 200k spent in the business? As I read it in guidance, it clearly says that all money must be spent.

Actually my question is if 2 people working for one year and doing 60 hrs per week that mean they are meeting requirement of 4 people doing 30 hrs per week.....so its mean these two must be considered as 4 epmloyees....but new guidlines states that hours worked more than 30 is not considered.....my question is as i got visa 2 years ago can i claim them on the basis of old rules......??

In the application form for extension or even in Set (o) where it says AMOUNT INVESTED and DATE OF INVESTMENT.....what does it mean, you cant invest all 200k in on one day.......I dnt understand this silly thing.....anyone help plz?

I have got tired of redundant questions and hence not answering any - they are all answered above. if you don't know how to read the whole thread and infer the details, which cannot be made more crystal clear than this, then I am not sure how you run a whole bldy company!

No I cannot post a 10 page document here, and no accountant gives u a editable copy of it.

Just get your accountant to do it, its the same for all.
